Towards transparency and efficiency in land management

The 2024 Land Law consists of 16 chapters and 260 articles, effective from August 1, 2024. After one year of implementation in Son La province, it has contributed to overcoming overlaps and conflicts in land policies and laws; at the same time, resolving many difficulties in land management and use.

Implementing the Land Law 2024, the Department of Agriculture and Environment has advised the Provincial People's Committee to issue 24 legal documents (including 2 resolutions and 22 decisions) providing detailed instructions on the implementation of the law; issued decisions adjusting land use planning indicators until 2030, with a vision to 2050; allowed the establishment of projects to develop land price lists applicable from January 1, 2026; and advocated the establishment of specific land price estimates for projects. Promoted propaganda and training on new contents and organized online conferences to disseminate the Law to localities, attracting nearly 2,500 participants.

Implementing decentralization, delegation of authority and assignment of responsibilities in the land sector according to the 2-level local government model, the Department of Agriculture and Environment has reviewed and completed the dossier to amend and supplement relevant legal documents; developed and promulgated 46 lists of administrative procedures (TTHC) on land from the provincial to commune levels; of which, 14 TTHC are under the authority of the commune level. According to Decree No. 151/2025/ND-CP dated June 12, 2025, the People's Committees of communes and the Chairmen of the People's Committees at the commune level are assigned additional authority in the land sector, such as: land allocation, land lease, and issuance of Land Use Right Certificates to organizations. To ensure effective implementation, the Department has organized training, professional guidance and established a working group to provide 24/7 professional support for communes and wards.

In addition, the Department of Agriculture and Environment has also done a good job of reforming administrative procedures, appraising documents related to land allocation, leasing, changing land use purposes, extending, and granting land use right certificates and assets attached to land to organizations. Synchronously deploying technical solutions to update land data from localities to the national database system. At the same time, speeding up site clearance for 4 key projects: Co Noi Intersection relic site; the road from sub-area 26/3 (Co Noi commune) to sub-area 10 (Hat Lot commune); upgrading the Nam Ty - Muong Chanh road; renovating provincial road 111.

However, the implementation of the 2024 Land Law in the area still faces difficulties, due to some unclear regulations that can be easily misunderstood in different ways, especially regarding land use planning, compensation, site clearance, and land use rights auctions; the land database is not yet synchronized and has not been effectively exploited to serve management, people, and businesses.

The Department of Agriculture and Environment has advised the Provincial People's Committee to propose to the National Assembly , in the Draft Law on Land Amendment (submitted at the October 2025 session), to focus on a number of contents: Eliminate the 5-year land use plan at the commune level; expand the cases of land allocation and lease without auction to increase land access and select qualified investors; eliminate the regulation on making a land use plan for the area of agricultural and forestry farms handed over to localities, in order to shorten procedures; simplify the process of land recovery, compensation, and resettlement support for flexible application in practice.

The Department of Agriculture and Environment has estimated about 1,700 billion VND to implement the Project of measuring and building a land database for the whole province. At the same time, it proposed to mobilize investment resources, complete technological infrastructure, promote innovation associated with digital transformation according to Resolution No. 57-NQ/TW dated December 22, 2024 of the Politburo on breakthroughs in science and technology development, innovation and national digital transformation, striving to complete by 2030.

To ensure effective implementation of the 2024 Land Law and timely removal of "bottlenecks" in the land sector, departments, branches and localities will continue to promote propaganda so that people can clearly understand the core content, new points and appropriate points of the law, thereby strictly implementing legal regulations on land.
