Continuing the 46th session, on the morning of June 9, the National Assembly Standing Committee listened to Chairman of the Committee for Culture and Social Affairs Nguyen Dac Vinh report on a number of major issues in explaining, receiving and revising the draft Law on Teachers.
According to Mr. Nguyen Dac Vinh, a notable new point is that the draft Law on Teachers has clarified the subjects of regulation, including teachers working under labor contracts and those with the title of teacher who also holds a management position; retired teachers who are teaching at non-publiceducational institutions. The draft law does not regulate other personnel such as school staff or guest teachers, because these subjects are regulated by the Law on Education, the Law on Vocational Education and the Law on Higher Education.
Incorporating the opinions of delegates, the draft law stipulates that university lecturers have the right to participate in the management and operation of enterprises. Mr. Nguyen Dac Vinh also stated: “The proposal to expand this policy to vocational education teachers needs to be carefully studied. After evaluating and summarizing the implementation practices, there will be a basis for expanding the subjects in the next stage. The assignment of tasks and balancing of working time of teachers participating in the management and operation of enterprises will be specified in detail in the implementation guidance document”.
Regarding extra teaching and learning - the content that has received special attention from society, the draft law stipulates that it does not absolutely prohibit extra teaching and learning, but clearly stipulates that teachers are not allowed to force students to participate in extra learning in any form. Detailed regulations on teachers not being allowed to teach extra to students they are directly teaching have been issued by the Ministry of Education and Training.
For teachers in the non-public sector, salaries are implemented according to the provisions of the law on labor, without stipulating a salary level "not lower than the public sector".
Regarding salary policy for teachers in public educational institutions, the draft law institutionalizes the Party's policy in Conclusion No. 91-KL/TW of the Politburo (continuing to implement Resolution No. 29-NQ/TW, dated November 4, 2013 of the 11th Party Central Committee "On fundamental and comprehensive innovation of education and training, meeting the requirements of industrialization and modernization in the conditions of a socialist-oriented market economy and international integration" - PV), clearly stipulates that teachers' salaries and allowances are ranked highest in the administrative career salary scale system.
For teachers in the non-public sector, salaries are implemented according to the provisions of the law on labor, without stipulating a salary level "not lower than the public sector" to facilitate the socialization of education and ensure the principles of voluntariness and autonomy of non-public institutions.
In addition, in accordance with the principles of new law-making, the draft law is revised in a way that it does not directly amend, supplement, or abolish a number of articles and clauses of the Law on Education, the Law on Higher Education, and the Law on Vocational Education. Instead, the Government will include the provisions that need to be amended, supplemented, or abolished in the three specialized laws mentioned above when submitting them to the National Assembly for consideration and decision at the 10th session.
