There is no absolute ban on tutoring or extra classes.

The revised draft Law on Teachers stipulates that while it does not absolutely prohibit tutoring or supplementary classes, it clearly states that teachers are not allowed to force students to participate in supplementary classes in any form.

Continuing the agenda of the 46th session, on the morning of June 9th, the Standing Committee of the National Assembly heard a report from the Chairman of the Committee on Culture and Society, Nguyen Dac Vinh, on several major issues in explaining, receiving feedback, and revising the draft Law on Teachers.

According to Mr. Nguyen Dac Vinh, a notable new point is that the draft Law on Teachers has clarified the scope of regulation, including teachers working under labor contracts, as well as those holding teaching positions who also serve as managers; and retired teachers who are currently teaching at non-public educational institutions. The draft law does not regulate other personnel such as school staff or visiting lecturers, as these groups are regulated by the Law on Education, the Law on Vocational Education, and the Law on Higher Education.

Responding to delegates' opinions, the draft law stipulates that university lecturers have the right to participate in the management and operation of businesses. Mr. Nguyen Dac Vinh also clarified: “The proposal to expand this policy to vocational education teachers needs careful study. After evaluating and summarizing the practical implementation, there will be a basis for expanding the scope in the next stage. The assignment of tasks and the balancing of time allocation for teachers participating in the management and operation of businesses will be specified in detail in the implementing guidelines.”

Regarding tutoring and supplementary classes – a topic receiving particular attention from society – the draft law stipulates that while it does not absolutely prohibit tutoring and supplementary classes, it clearly states that teachers are not allowed to force students to participate in any form of supplementary classes. Detailed regulations prohibiting teachers from providing supplementary classes to students they directly teach have already been issued by the Ministry of Education and Training.

For teachers in the non-public sector, salaries are determined according to labor laws, and there is no provision stating that salaries must be "not lower than those in the public sector."

Regarding salary policy, for teachers in public educational institutions, the draft law institutionalizes the Party's policy in Conclusion No. 91-KL/TW of the Politburo (continuing to implement Resolution No. 29-NQ/TW, dated November 4, 2013, of the Central Committee of the 11th Party Congress "On fundamental and comprehensive reform of education and training, meeting the requirements of industrialization and modernization in the context of a socialist-oriented market economy and international integration" - PV), clearly stipulating that the salaries and allowances of teachers are ranked highest in the administrative and public service salary scale system.

For teachers in the non-public sector, salaries are determined according to labor laws, without a stipulated minimum salary "not lower than in the public sector" to facilitate the socialization of education and ensure the voluntary and autonomous principles of non-public institutions.

Furthermore, in accordance with the principles of new lawmaking, the draft law has been revised to avoid directly amending, supplementing, or repealing certain articles and clauses of the Law on Education, the Law on Higher Education, and the Law on Vocational Education. Instead, the Government will incorporate the necessary amendments, supplements, or repeals into the three aforementioned specialized laws when submitting them to the National Assembly for consideration and decision at the 10th session.
