When Mrs. Hoa went to the (new) commune to inquire about the procedures, she was informed that they could not find the land allocation document and that her family did not have a land allocation decision. She asked what her family should do to obtain a Certificate of Land Use Rights.
The Ministry of Agriculture and Environment responded to this issue as follows:
Clause 7 of Article 137 of the 2024 Land Law stipulates that the first issuance of a Certificate of Land Use Rights and Ownership of Assets Attached to Land applies to households and individuals currently using land who possess a copy of a document proving the State's allocation of land in accordance with regulations prior to the effective date of the 2024 Land Law (documents specified in Clause 4 of Article 137 of the 2024 Land Law), but the original document has been lost and the state agency no longer retains records of the issuance of such documents.
Furthermore, she has the right to file a complaint regarding land management as stipulated in Article 237 of the 2024 Land Law. Based on the resolution of the complaint by the competent state agency, the land allocation and issuance of the Certificate of Land Use Rights will be carried out in accordance with regulations.
