Infringing advertisements on infringing websites.
Upon accessing the website bongdalu4.com, dozens of advertisements immediately fill the entire screen. Specifically, apart from the header, navigation bar, and main content in the middle of the page, the remaining area of the website is occupied by advertisements – up to 70%.
Observations by Lao Dong newspaper on January 3rd, 4th, and 5th revealed that the advertisements placed on this website were all related to football betting, gambling games, online casinos, fish shooting games, lottery, etc. Of nearly 40 advertisements on this site, only two at the bottom of the page could be ignored by users. All other advertisements were forced upon users when accessing the website. Despite displaying numerous advertisements that showed signs of violating the law, the website owner denied all responsibility.
"All advertisements on our website are the personal opinions of our customers and have no connection to our website," the website owner stated.
The website bongdalu4.com is one of 403 websites showing signs of violating the law in 2023, as recently announced by the Department of Broadcasting, Television and Electronic Information (Ministry of Information and Communications).
Similarly, the website vebo2.tv – a website listed by the Ministry of Information and Communications as showing signs of violating the law in the third quarter of 2022 – is also currently flooded with advertisements. This website only displays one type of advertisement, but it is an advertisement for football betting services. These advertisements appear densely in seven locations on the website.
Place ads on websites that are on the "whitelist".
On July 20, 2021, Decree 70/2021/ND-CP, amending and supplementing several articles of Decree 181/2013/ND-CP detailing the implementation of the Advertising Law, was issued by the Government . According to Decree 70/2021/ND-CP, advertising service providers, advertising publishers, and advertisers who fail to cooperate in publishing advertising products with websites that have been publicly notified of legal violations on the Ministry of Information and Communications' electronic portal by competent authorities are subject to penalties.
In accordance with the above regulations, the Ministry of Information and Communications publishes a list of websites that violate the law (providing gambling advertising content, providing illegal online games with gambling or reward-based activities, etc.) so that advertising service providers, advertisers, and advertisers can be aware and avoid publishing advertisements on these websites.
Previously, at the Ministry of Information and Communications' regular press conference, Deputy Minister Nguyen Thanh Lam stated that the Ministry had compiled a "whitelist" – including websites, addresses, and content platforms that have been licensed/verified by the Ministry. The Ministry recommends that Vietnamese brands and advertising services place their advertisements on these websites.
"We cannot allow decent advertisements to be placed on websites that infringe on copyright," Mr. Lam said.
Furthermore, the Deputy Minister of Information and Communications suggested that advertising should be "redirected" by blocking or removing advertisements for services that violate the law, such as gambling and betting, because these sites find their "breeding ground" on websites that infringe on copyright.
