Recently, many countries have been continuously tightening controls through labeling and penalties for violations related to the use of images created using artificial intelligence (AI) technology.

In reality, images and videos created using AI have become a new technological trend, bringing many positive applications, but also carrying significant risks when used for wrongful or illegal purposes. These include infringing on privacy, being used for fraud, manipulating public opinion, and identity fraud. Therefore, control is essential to prevent these risks.

Currently, the Artificial Intelligence Law, effective from March 1st in Vietnam, also stipulates the responsibilities of the "implementing party"—organizations and individuals using artificial intelligence systems under their control in professional, commercial, or service-providing activities (excluding use for personal, non-commercial purposes). For example, Clause 4, Article 11 of the law states: The implementing party is responsible for ensuring that audio, images, and videos created or edited using artificial intelligence systems to simulate or replicate the appearance and voice of real people or to reproduce real events are clearly labeled to distinguish them from real content.

These are necessary regulations, and most "implementing parties" have complied with them early on. However, many images from individual, non-commercial users are still appearing on social media, causing considerable confusion and inaccuracies. This situation highlights the need to further strengthen regulations requiring mandatory labeling and control over those using AI images.

Recently, the Government issued Decree No. 174/2026/ND-CP stipulating administrative penalties for violations in the fields of postal services, telecommunications, radio frequencies, electronic transactions, and information technology. Of particular note are the regulations on penalties for violations concerning responsible use of social media services. This Decree will take effect from July 1st. This is also an important legal basis for rectifying many violations occurring in cyberspace, especially on social networks. In reality, social networks are being exploited for profit by many individuals, organizations, and businesses without regard for consequences, so it needs to be quickly rectified.

However, for these legal frameworks to truly bring about positive change, the role of relevant authorities is clearly crucial. Alongside legal regulations, the involvement of relevant agencies is essential as violations are increasingly creating serious consequences. Furthermore, each citizen needs to enhance their awareness and understanding of the law when using AI-generated content and engaging on social media, as violations can now have significant consequences.
