Need to review the regulations on lump sum spending

On the morning of May 16, the National Assembly discussed the draft Resolution of the National Assembly on a number of special mechanisms and policies, creating breakthroughs in law making and enforcement.

Delegate Pham Van Hoa ( Dong Thap ) said that currently, officials directly participating in drafting legal documents and advising on drafting laws are very important, have a lot of work, and come with preferential policies for this group.

"This policy, when issued, will stimulate the responsibility of officials, avoid the situation of interweaving group interests into policies, or building crooked legal policies," the delegate commented.

Going into specific comments, Deputy Pham Van Hoa said that he also supports the annual budget spending of no less than 0.5% of the total budget spending for the work of drafting legal documents, depending on each period. However, the Deputy is concerned about the subjects of the spending allocation which is considered high in the draft. According to the Deputy, the spending allocation of 20 billion VND to build a new law is high, this needs to be considered.

"As a direct cadre, having a regime at work but still being allocated spending, I agree that there should be a budget, but considering the budget of up to 20 billion VND to build a new law is a bit high. Or like building a document to supplement and amend a number of articles and being allocated spending up to 9 billion VND or issuing a Government decree, just a few articles assigned by the National Assembly but receiving several billion VND is unreasonable", Deputy Pham Van Hoa expressed his opinion.

Meanwhile, Deputy Huynh Thi Anh Suong (Quang Ngai) suggested that it is necessary to institutionalize the work of preventing negativity in law-making; at the same time, protect party members, cadres, civil servants and public employees who are creative, dare to think, dare to do, and dare to take responsibility for the common good.

Delegate Huynh Thi Anh Suong stated that the regulations on subjects entitled to special policies during the process of drafting legal documents should be reviewed during the process of drafting and promulgating legal documents to fully determine the roles of the subjects. The Delegate also suggested considering the regulations on the principle of benefit levels and support corresponding to the ability, experience and results of performing tasks in drafting laws.

Proposal to add breakthrough mechanism for law enforcement

Meanwhile, Deputy Nguyen Thi Viet Nga (Hai Duong) said that the regulation of establishing a non-profit non-budgetary policy development support fund will diversify resources for law-making work, ensuring flexibility for proposals and projects that are not funded by the state.

However, the delegate suggested that it is necessary to clarify the feasibility of resource mobilization, because in reality we have established a number of extra-budgetary funds, but they are difficult to mobilize and deploy, and implementation is not effective. Along with that, the delegate suggested that the Government have clear and reasonable regulations on the proportion and limits of using State budget financial resources in the task of building legal policies to ensure balance in the use of financial resources.

Delegate To Ai Vang (Soc Trang) proposed adding 2 more subjects to receive monthly support when drafting legal documents: full-time delegates and full-time civil servants of the Provincial People's Council of the Legal Committee, the Economic and Budget Committee, and the Cultural and Social Committee, because they also have similar functions and tasks according to their assigned fields; secondly, they are the Chief of Office, 1 Deputy of Office in charge of the National Assembly work field and civil servants of the National Assembly Work Department.

Participating in giving comments on the draft Resolution, Deputy Nguyen Duy Minh (Da Nang City) said that the draft resolution seems to focus on special mechanisms and policies to support the work of law-making, while the work of organizing law enforcement - one of the weak links at present - still lacks mechanisms and policies to resolve.

Therefore, Deputy Nguyen Duy Minh suggested that the drafting agency study and add more breakthrough mechanisms and policies to better organize law enforcement. The Deputy also suggested adding the subjects of the People's Council's committees, civil servants in the office advising and assisting the National Assembly delegation to the subjects entitled to enjoy the policies in the draft Resolution.

As the drafting agency, Minister of Justice Nguyen Hai Ninh said that he will work with the National Assembly's Committee on Law and Justice to study, absorb, and report to the Government and the National Assembly Standing Committee to revise and complete the draft resolution in a quality manner, and submit it to the National Assembly for consideration and approval.
