According to the Provincial People's Committee, currently, most of the land area within the road safety corridor has not been collected and recorded for management (except for sections passing through urban areas that have been approved for planning according to red lines). Residential areas that have been approved for planning along local roads that have been upgraded to provincial roads and national highways have not been adjusted in time according to road levels; at the same time, the upgrading and expansion of some sections of roads has not collected all of the land within the road safety corridor, leading to construction according to the granted land use right certificates. This is a problem that causes difficulties between institutional implementation and practice in the management and handling of violations of road safety corridor order by road management agencies and local authorities.
To manage construction on land within the road safety corridor but the State has not yet reclaimed the land, ensure the people's land use rights and comply with the provisions of law, the Provincial People's Committee requests the Department of Culture, Sports and Tourism to coordinate with authorities at all levels, relevant agencies and units to guide local press agencies and grassroots information systems to promote propaganda and dissemination of legal provisions on construction on land within the road safety corridor. Local People's Committees shall preside over and coordinate with units directly managing road works and relevant forces to monitor, guide and manage construction on land within the road safety corridor but the State has not yet reclaimed the land; resolutely and promptly handle violations; propagate and disseminate regulations to all classes of people.
The Provincial People's Committee also requested the Provincial Police to arrange forces to ensure security and order for the enforcement work of the District People's Committee when enforcing and clearing encroachment, occupation, use, and construction works on land within the road safety corridor that has not been recovered by the State and does not have a land use right certificate according to the provisions of the law on land. The Department of Construction is responsible for monitoring, inspecting, and urging the implementation; promptly advising and proposing to the Provincial People's Committee to direct arising issues.
