Recently, the People's Committee of Ea Sup district ( Dak Lak ) has reclaimed more than 622 hectares of encroached forestry land in sub-zones 267 and 268 of Ea Bung commune without having to organize enforcement. This is a good experience for localities to apply in the future.
According to the report of the People's Committee of Ea Sup district, sub-areas 267 and 268 of Ea Bung commune have a total area of 1,877.37 hectares. In December 2012, the People's Committee of Dak Lak province leased 714.37 hectares of land in sub-areas 267 and 268 of Ea Bung commune to Thai Binh Phat Real Estate Joint Stock Company (Thai Binh Phat Company) to implement the project of forest improvement, management and protection. However, due to ineffective project implementation and the enterprise's violations of the law on land management, forest management and protection and illegal encroachment, in February 2017, the People's Committee of Dak Lak province decided to reclaim and hand over the entire project area of Thai Binh Phat Company to the People's Committee of Ea Sup district for management.
Chairman of the People's Committee of Ea Sup district Do Xuan Dung said that in the period of 2017-2019, after receiving the land area assigned by the province for management, the district reviewed and assessed the current situation of forest management, protection, and land management in this area; at the same time, implementing the policy of the Provincial Party Committee and the Provincial People's Committee on recovering encroached forestry land in the province, in which it agreed to let the People's Committee of Ea Sup district pilot the recovery and site clearance of an area of about more than 1,000 hectares of forestry land in sub-areas 267 and 268 of Ea Bung commune.
Ea Sup District Party Committee has organized many conferences to discuss, unify viewpoints and policies, propose specific tasks and solutions to lead the work of forest management, protection, and land management in the area; issue specialized resolutions, programs, plans, directives, and documents focusing on leading the implementation of recovering encroached forestry land in sub-areas 267 and 268 of Ea Bung commune.
In the period of 2020-2023, one of the key tasks of Ea Sup district is to "focus on leading the handling of hot spots of deforestation, encroachment, illegal trading, construction of houses and camps on forestry land..."; at the same time, implementing the conclusions of supervision, inspection and examination of the Central Inspection Committee, the Government Inspectorate , the Provincial Steering Committee 1287 and the Provincial Party Committee's Inspection Committee on overcoming limitations and shortcomings in forest management, protection, and recovery of encroached land.
Ea Sup District Party Committee continues to strengthen leadership, direction, develop programs, plans and resolutely implement this task. During this period, Ea Sup District has completed all field measurements of encroached land areas, established records for handling violations and proposed the Provincial People's Committee to issue decisions on handling violations and decisions on compulsory remediation of consequences for cases of illegal land encroachment in sub-areas 267 and 268 of Ea Bung Commune, with a total area of 556.49 hectares.
From the end of 2023, implementing the direction of Deputy Prime Minister Tran Luu Quang, the direction of the Ministry of Public Security and the regular, close and drastic leadership and direction of the Provincial Party Committee and the Provincial People's Committee, together with the coordination and support of departments and branches; especially the great attention, guidance and support of the Provincial Police, the professional departments of the Provincial Police, especially in supporting the grasp of the situation of the area, subjects, recovering weapons and explosives, using professional measures to call and question, deter prominent subjects, arrange forces and means to ensure security and order... to serve the land recovery work in sub-areas 267 and 268 of Ea Bung commune.
In addition, Ea Sup district established a Steering Committee to handle complicated cases of land management, forest management and protection, and complaints in the district, and put the task of land recovery in sub-areas 267 and 268 of Ea Bung commune on the list of regular monitoring and direction of the District Steering Committee 754.
After completing the field measurement, the People's Committee of Ea Sup district has developed plans, scenarios, and established committees and working groups to carry out enforcement tasks, security and order assurance plans, etc. In 2024, the People's Committee of Ea Sup district has focused on directing resolutely, flexibly, creatively, and persistently applying many measures and solutions to recover the entire area of encroached land, in which it is especially important to direct individual propaganda and mobilization work combined with professional measures of the police force and promptly implement social security policies, take care of people's daily lives, guide and facilitate the settlement of administrative procedures on household registration, land registration, and address the legitimate needs of each violator, support and mobilize children to go to school, etc. so that the subjects trust and agree with the government and voluntarily return the land.
Accordingly, from June 19 to October 11, 2024, the People's Committee of Ea Sup district propagated, mobilized, and persuaded 129 households to voluntarily return their land, an increase of 25 households compared to the Decisions of the Provincial People's Committee, with the recovered area being 622.27/556.49 hectares, reaching 111% of the planned recovered area without having to organize enforcement.
Immediately after the people voluntarily returned the land, Ea Sup district cleared the land in sub-areas 267 and 268 of Ea Bung commune, including 169.20 hectares of perennial crops and 227.63 hectares of annual crops and 80 huts and sheds. Through three rounds of site clearance in December 2024, the People's Committee of Ea Sup district cleared the entire 622.27 hectares of 129 households; including cutting down 169.20 hectares of perennial crops such as cashew and mango; plowing and destroying 227.63 hectares of annual crops including sugarcane, cassava, and beans; dismantling 79/80 huts and sheds; one household requested to dismantle one hut, leaving about 225.44 hectares of vacant land. In addition, Ea Sup district also mobilized and communicated with households to dismantle 15 huts and sheds outside this land clearance period.
Chairman of the People's Committee of Ea Sup district Do Xuan Dung said that after recovering and clearing more than 622 hectares of land in sub-areas 267 and 268 of Ea Bung commune, the People's Committee of the district directed the People's Committee of Ea Bung commune to strengthen strict management of the recovered land fund, not to allow re-encroachment; supplement the commune's land use plan and plan. The district police have stepped up monitoring, grasping the situation, and ideological developments in households that have agreed and voluntarily returned the land, preventing cases of being lured and incited by hostile forces and bad elements to return to cause trouble and reclaim the land.
The People's Committee of Ea Sup district also proposed that the People's Committee of Dak Lak province consider and prioritize increasing resources to invest in infrastructure development, preservation and promotion of culture, traditional crafts, community cultural tourism, etc. for five ethnic minority villages in Ea Sup town to create jobs, increase local income for people, limit shifting cultivation and nomadic encroachment on land, and at the same time propose that the province consider and soon call for investors with sufficient capacity to implement projects in sub-areas 267 and 268 of Ea Bung commune to improve the efficiency of using and protecting forestry land.
Ea Sup District Party Secretary Bui Hong Quy assessed that the recovery of more than 622 hectares of encroached forestry land in sub-areas 267 and 268 of Ea Bung commune was complicated and difficult. However, the recovery work was organized in a systematic and large-scale manner with many good and creative ways, especially with the strong direction of the leaders of the Provincial Party Committee and the Provincial People's Committee, the guidance and support of the provincial departments and branches, especially the Provincial Police, and the strong participation of the entire political system from the district to the commune with both flexible and firm solutions, so the land recovery work was completed without having to organize enforcement. This is also the basis and experience for the local government to continue the recovery of encroached forestry land in the district in the coming time.
Deputy Director of the Department of Natural Resources and Environment of Dak Lak province, Luu Minh Duc, said that in the province in general and Ea Sup district in particular, the situation of encroachment on forestry land is complicated. The organization of the recovery of more than 622 hectares of forestry land without forced eviction like in Ea Sup district is unprecedented in the province. This is an important lesson for localities to apply.
