The amended Law on Cultural Heritage was passed with 9 new points.

Before proceeding to the vote, the National Assembly heard a report presented by Nguyen Dac Vinh, Chairman of the National Assembly's Committee on Culture and Education, on the acceptance, explanation, and revision of the draft Law on Cultural Heritage (amended).

The draft Law on Cultural Heritage (amended), passed by the National Assembly , consists of 9 chapters and 95 articles, regulating cultural heritage, the management, protection, and promotion of cultural heritage values; and the rights, obligations, and responsibilities of agencies, organizations, communities, and individuals in the management, protection, and promotion of cultural heritage values ​​of the Socialist Republic of Vietnam.

Compared to the current Law, the Draft Law on Cultural Heritage (amended) has 9 new points, including: specific regulations on the establishment of cultural heritage according to each type of ownership (state ownership, common ownership, private ownership) in accordance with the Civil Code and other relevant legal provisions; regulations on the State's policy in the protection and promotion of cultural heritage values, prioritizing the allocation of State budget for activities with specific characteristics; and training and fostering human resources involved in the management, protection, and promotion of cultural heritage values.

The draft Law also refines the list of prohibited acts to ensure greater accuracy and completeness, serving as a basis for guiding implementation, inspection, and handling violations in the protection and promotion of cultural heritage values; specifically identifies cases for adjusting the protection boundaries of monuments, world heritage sites, and buffer zones of world heritage sites; and stipulates the principles and authority for adjusting the boundaries of protected areas to ensure feasibility in practice.

The regulations specify the repair, renovation, and construction of individual buildings and houses inside and outside protected areas of historical sites; regulations on the management of artifacts, antiques, and national treasures; the handling of discovered and surrendered artifacts and antiques; the addition of the Cultural Heritage Preservation Fund; policies for protecting and promoting the value of documentary heritage; and policies to support the development of the museum system.

The Law applies to agencies, organizations, communities, and Vietnamese people residing in Vietnam; agencies, organizations, communities, and foreigners residing and operating in Vietnam; and Vietnamese people residing and operating abroad, all of whom are involved in the management, protection, and promotion of cultural heritage values.

The law clearly states that the State plays a leading role in ensuring and developing activities to protect and promote the value of cultural heritage; mobilizing social resources for activities to protect and promote the value of cultural heritage of regions, areas, and ethnic groups;

At the same time, priority should be given to allocating state budget funds for activities to protect and promote the value of cultural heritage that has been inscribed or recognized by UNESCO; to protect and promote the value of the spoken and written languages ​​of Vietnamese ethnic groups; and to protect and promote the value of cultural heritage in ethnic minority and mountainous, border and island regions…

The law stipulates that the Cultural Heritage Preservation Fund is a non-budgetary state financial fund, established and operating in accordance with the law to provide financial support for activities to protect and promote the value of cultural heritage that has not been invested in, supported, or has not received sufficient investment from the state budget (protecting intangible cultural heritage at risk of disappearing or being lost; implementing projects and items for the preservation, restoration, protection, and promotion of the value of historical sites; purchasing and bringing artifacts, antiques, national treasures, documentary heritage, and rare documents on intangible cultural heritage of Vietnamese origin from abroad back to the country...).

The Law designates the Ministry of Culture, Sports and Tourism as the focal agency assisting the Government in the unified state management of cultural heritage. It also requires ministries and ministerial-level agencies, within their respective duties and powers, to coordinate with the Ministry of Culture, Sports and Tourism in carrying out the state management of cultural heritage as stipulated in this Law and other relevant laws.

The Law on Cultural Heritage (amended) will come into effect on July 1, 2025.
