New regulations on subjects and levels of health insurance contributions

The Government issued Decree No. 188/2025/ND-CP detailing and guiding the implementation of a number of articles of the Law on Health Insurance.

The Decree takes effect from August 15, 2025.

In which, the Decree clearly stipulates the subjects, contribution levels, and support levels for health insurance contributions.

Professor - Doctor Tran Van Thuan, Deputy Minister of Health , Chairman of the National Medical Council emphasized: Decree No. 188/2025/ND-CP is also a concrete result of the process of synchronous institutionalization of major policies of the Party, contributing to perfecting the legal system on health insurance in a synchronous, feasible, transparent and practical manner.

According to Deputy Minister Tran Van Thuan, Decree No. 188/2025/ND-CP clearly demonstrates the spirit of administrative reform and governance innovation according to Resolution 66 (on innovation in law making and enforcement) and promotes comprehensive digital transformation in the organization and implementation of health insurance policies, a step to concretize Resolution 57 in the health sector.

This Decree has a number of new points, such as: adding cases that are not considered as health insurance evasion; adding regulations on health insurance support levels for certain subjects; amending and supplementing the responsibilities of the agency implementing the transfer of health insurance premiums and the agency making the list of health insurance card issuance for groups of subjects participating in health insurance; adding regulations on health insurance card issuance procedures.

In order to promote the application of information technology, digital transformation and meet the needs and accessibility conditions of all people, the Decree provides specific instructions on the implementation of procedures for issuing electronic and paper health insurance cards to health insurance participants on the National Public Service Portal or via the application of the social insurance agency or directly at the one-stop department of the social insurance agency, or sending via public postal service to the social insurance agency...

The time when children's health insurance cards are valid is stipulated by the Decree as follows: Children born before September 30: From the date of birth to the end of September 30 of the year the child is 72 months old; Children born after September 30: From the date of birth to the end of the last day of the month the child is 72 months old.

For students who pay health insurance annually, the validity of the health insurance card is as follows: Grade 1 students: From 01-10 of the first year of primary school; from the last day of the month the child turns 72 months old if the child was born after September 30; Grade 12 students: From January 1 to September 30 of that year. Grade 12 students are encouraged to pay health insurance and enjoy the support level until December 31 of the last school year to ensure continuous health insurance benefits, without having to repay the support fee in case of change of subject.

Conditions for educational association in public schools in Hanoi

The Government issued Decree No. 202/2025/ND-CP detailing the conditions, procedures, educational programs, granting of diplomas and certificates for implementing educational linkages and teaching integrated educational programs for public preschool and general education institutions in Hanoi city.

This Decree consists of 6 chapters and 21 articles detailing the conditions, procedures, educational programs, granting of diplomas and certificates for implementing educational linkages and teaching integrated educational programs for public preschool and general education institutions in Hanoi city.

The subjects of application are public preschool and general education institutions of Hanoi city, including: nurseries, kindergartens, preschools, primary schools, junior high schools, high schools, multi-level general schools and related organizations and individuals implementing educational cooperation with foreign educational institutions and organizations. Foreign educational institutions and organizations implementing educational cooperation with public preschool and general education institutions of Hanoi city.

The Decree stipulates that the Hanoi People's Committee approves educational partnerships; the procedures for approving educational partnerships. The Decree stipulates that the term of educational partnerships shall not exceed 5 years from the date of approval and may be extended, each extension shall not exceed 5 years.

This Decree comes into force from August 27, 2025.

Regime and policies for people mobilized to participate in people's air defense activities

The Government issued Decree No. 198/2025/ND-CP detailing a number of articles and measures to implement the Law on People's Air Defense.

This Decree details Clause 4, Article 9, Clause 6, Article 38 and Article 44 of the Law on People's Air Defense on the position, functions, tasks, organizational structure and operation of the People's Air Defense Steering Committees at all levels; the scope and height of air defense obstacles of air defense positions; the regime and policies for those mobilized to participate in people's air defense activities and the content of state management of people's air defense.

The Decree stipulates that employees who are mobilized to participate in people's air defense activities and are injured in one of the cases prescribed in Clause 1, Article 23 of Ordinance No. 02/2020/UBTVQH14 dated December 9, 2020 of the Standing Committee of the National Assembly on Incentives for People with Meritorious Services to the Revolution;

Article 34 of Decree No. 131/2021/ND-CP dated December 30, 2021 of the Government detailing and implementing the Ordinance on preferential treatment for people with revolutionary contributions shall be considered and recognized as war invalids and people enjoying policies like war invalids; if they die in one of the cases prescribed in Clause 1, Article 14 of Ordinance No. 02/2020/UBTVQH14; Article 14 of Decree No. 131/2021/ND-CP, they shall be considered and recognized as martyrs.

The dossier and procedures for recognizing beneficiaries of policies such as war invalids and martyrs shall comply with the provisions of Decree No. 131/2021/ND-CP dated December 30, 2021 of the Government on detailed regulations and measures to implement the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution.

The above Decree takes effect from August 22, 2025.

Connecting and sharing data in electronic transactions of state agencies

The Government issued Decree No. 194/2025/ND-CP detailing a number of articles of the Law on Electronic Transactions on national databases, data connection and sharing, and open data serving electronic transactions of state agencies. The Decree takes effect from August 19, 2025.

The Decree stipulates that data in state agencies must be shared with agencies, organizations and individuals in the following cases, unless the law stipulates that sharing is not allowed: Data arising from a state agency must be shared by that state agency; State agencies managing sectors and fields at the local level must share data from national databases, databases of ministries and sectors according to the scope of sectors and fields managed by that state agency; Shared databases of any level must be shared by units under that level in accordance with the assigned functions and tasks.

In addition to the above provisions, shared data and open data in state agencies must by default be shared with state agencies to serve state management activities under their authority upon request. In case of refusal to share data, a written response must be given stating the reasons and specifying the legal basis for restricting data sharing. In case of any problems, follow the procedures for handling problems regarding management, connection and sharing of digital data of state agencies.

People working in digital transformation are supported with 5 million VND/month

On July 1, 2025, the Government issued Decree No. 179/2025/ND-CP stipulating the level of support for people working full-time on digital transformation, network information security, and network security.

This Decree stipulates the level of support for people working full-time on digital transformation, network information security, and network security in agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front (including socio-political organizations) from the central to communal levels and armed forces (army, police, cryptography).

According to the Decree, the above subjects are entitled to a support level of 5 million VND/month.

The above support level is paid with the monthly salary and is not used to calculate social insurance and health insurance contributions and benefits.

This support level is applied until the salary policy reform is implemented according to the policy of the competent authority.

According to the Decree, the time period not eligible for support includes: Time off work without pay continuously for one month or more; Time off work to enjoy social insurance benefits according to the provisions of the law on social insurance; Time of temporary detention, temporary detention, temporary suspension from work or suspension from work; Time of not undertaking professional or technical work specified above continuously for one month or more.

This Decree comes into force from August 15, 2025.
