Increase the level of benefits for people with revolutionary contributions

Decree 55/2023/ND-CP (effective from September 5, 2023) amends Decree 75/2021/ND-CP regulating the levels of allowances, subsidies and preferential regimes for people with revolutionary contributions, including increasing the level of allowances for people with revolutionary contributions from July 1, 2023.

Accordingly, the monthly allowance for people with revolutionary contributions and relatives of people with revolutionary contributions will be increased from July 1, 2023, for example:

- Level of benefits for relatives of martyrs:

+ For relatives of 01 martyr: Increase from 1,624,000 VND/month to 2,055,000 VND/month.

+ For relatives of 02 martyrs: Increase from 3,248,000 VND/month to 4,110,000 VND/month.

+ For relatives of 3 or more martyrs: Increase from 4,872,000 VND/month to 6,165,000 VND/month.

+ For biological fathers, biological mothers, people who have raised martyrs, martyrs' wives or husbands who live alone; martyrs' children under 18 years old or from 18 years old if they continue to go to school or have severe disabilities, especially severe disabilities and are orphans of both parents, they will receive additional allowance for raising them: Increased from 1,299,000 VND/month to 1,644,000 VND/month.

+ For the wife or husband of a martyr who marries another person and raises the martyr's children to adulthood or takes care of the martyr's biological father or mother while they are still alive or because of revolutionary activities, they do not have the conditions to take care of their biological father or mother while they are still alive: Increase from VND 1,624,000/month to VND 2,055,000/month.

- Subsidy level for Vietnamese Heroic Mothers: Increased from VND 4,872,000/month to VND 6,165,000/month.

Allowance level for caregivers of Vietnamese Heroic Mothers living in the family: Increased from VND 1,624,000/month to VND 2,055,000/month.

Supplementing principles for evaluating and classifying the quality of cadres, civil servants and public employees

Decree 48/2023/ND-CP (effective from September 15, 2023) amends Decree 90/2020/ND-CP on assessment and classification of the quality of cadres, civil servants and public employees.

Accordingly, supplement the principles for evaluating and classifying the quality of cadres, civil servants and public employees in Article 2 of Decree 90/2020/ND-CP as follows:

- Cadres, civil servants and public employees subject to party or administrative discipline shall have their quality assessed and classified as follows:

(1) Cadres, civil servants and public employees who are subject to party or administrative disciplinary action in the year of assessment shall be classified as having failed to complete their tasks, except for the case specified in Clause (2).

(2) In case the violation has not been subject to a disciplinary decision by a competent authority but has been used as a basis for assessing and classifying the quality as not completing the task in the assessment year, the disciplinary decision issued after the assessment year for that violation (if any) shall not be counted for assessing and classifying the quality in the year of the disciplinary decision.

(3) In case a cadre, civil servant or public employee is a party member and has been subject to party discipline and administrative discipline for the same violation but the party discipline decision and administrative discipline decision are not effective in the same year of assessment, it will only be considered as a basis for quality classification in one year of assessment.

- The proportion of cadres, civil servants and public employees classified as "Excellently completing tasks" out of the total number of cadres, civil servants and public employees at the same agency, organization or unit and for each group of subjects with similar tasks must not exceed the proportion of Party members classified as "Excellently completing tasks" according to Party regulations.

In case an agency, organization or unit has outstanding achievements, completes assigned tasks ahead of schedule, completes unexpected tasks well, proposes or organizes innovation, creates positive changes, brings practical value and efficiency, the competent authority shall decide on the rate of excellent task completion in accordance with reality, ensuring the rights and legitimate interests of cadres, civil servants and public employees.

Instructions on subsidy levels for retired commune officials

On August 1, 2023, the Ministry of Home Affairs issued Circular 11/2023/TT-BNV guiding the adjustment of monthly allowance levels for retired elderly commune, ward and town officials.

Accordingly, from July 1, 2023, retired elderly commune officials will have their monthly allowance adjusted according to the provisions of Article 2 of Decree No. 42/2023/ND-CP with the following calculation formula:

Monthly allowance = June 2023 allowance x 1.125

After the adjustment, if the subsidy level of retired old communal cadres is still lower than 3 million VND/month, this person will be increased by:

- Increase by 300,000 VND/person/month if the benefit level is less than 2.7 million VND/month/person.

- Increase by 3 million VND/person/month if the benefit level is from 2.7 - under 3 million VND/person/month.

With the above adjustment policy, retired old commune cadres will receive the following new allowance:

- Former Party Committee Secretary, Chairman of the People's Committee, Deputy Secretary, Vice Chairman, Standing Party Committee member, Secretary of the People's Committee, Secretary of the Commune People's Council, Commune Team Leader, Commune Police Chief: 3 million VND/month/person.

- Remaining positions: 2,817 million VND/month/person.

Circular 11/2023/TT-BNV takes effect from September 15, 2023.

7 cases where you cannot borrow money from the bank

Another notable new policy taking effect in September 2023 is the regulation on cases where bank loans are not allowed from September 1, 2023.

On June 28, 2023, the State Bank issued Circular 06/2023/TT-NHNN, amending and supplementing a number of provisions in Circular 39/2016/TT-NHNN, including provisions on "Capital needs that are not allowed to be lent to banks" with 10 specific cases, applicable from September 1, 2023.

However, on August 23, 2023, the State Bank continued to issue Circular 10/2023/TT-NHNN with the content of suspending the implementation of a number of cases that are not allowed to borrow bank capital until the effective date of the new legal document.

Thus, from September 1, 2023, credit institutions will not lend for the following 7 capital needs:

1 - To invest in business in industries and professions prohibited from investment and business according to the Investment Law.

2 - To pay for business expenses in prohibited investment and business sectors and other transactions and acts prohibited by law.

3 - To purchase and use goods and services in industries and professions prohibited from investment and business according to the Investment Law.

4 - To buy gold bars.

5 - To repay loans granted by the lending credit institution itself, except for loans to pay interest arising during the construction period, where the loan interest expense has been calculated in the total construction investment approved by the competent authority.

6 - To repay foreign loans (excluding foreign loans in the form of deferred payment for goods purchase), credit granted at other credit institutions, except for loans to repay debts before maturity and meeting 02 conditions:

The loan term shall not exceed the remaining loan term of the old loan;

Is a loan that has not had its repayment period restructured.

7 - To deposit money.

Flight delayed 5 hours, customer gets refund

This is the notable content mentioned in Circular 19/2023/TT-BGTVT amending, supplementing and abolishing a number of articles of Circulars regulating air transport (Effective from September 1, 2023).

Circular 19 clearly states that when there is a change in flight departure time, airlines are responsible for immediately notifying passengers of this change.

If the flight is delayed through no fault of the passenger, the airline must provide and update full information to the passenger; apologize to the passenger; ensure meals, accommodation, travel and bear other directly related costs appropriate to the waiting time at the airport.

In case of flight delay due to the fault of the carrier, airlines must also perform the following obligations:

- Flight delay of 02 hours or more: Change the itinerary to suit the passenger or transfer to another flight, exempt from restrictions on itinerary change or flight change and surcharges.

- Flight delay of 05 hours or more: If the customer does not request a flight change but requests a refund, the carrier will refund the entire ticket price or refund the unused portion of the ticket.

Mechanism to support vocational training for small and medium enterprise workers

To guide the mechanism for using state budget funds for regular expenditure to support small and medium enterprises according to Decree No. 80/2021/ND-CP, the Ministry of Finance issued Circular 52/2023/TT-BTC.

One of the highlights of Circular 52 is the mechanism to support vocational training for employees of small and medium enterprises.

According to Article 10 of Circular 52/2023/TT-BTC, employees who have worked in small and medium-sized enterprises for at least 06 consecutive months when participating in a primary vocational training course or a training program of 03 months or less will receive one-time support from the state budget for vocational training costs at the level announced by the vocational training institution but not exceeding 02 million VND/person/course.

The provisions of Circular 52/2023/TT-BTC take effect from September 23, 2023.
