Can vehicles be bought or sold from August 15, 2023, without license plates?

Based on Points a and b, Clause 4, Article 6 of Circular 24/2023/TT-BCA, when selling, gifting, inheriting, exchanging, contributing capital, allocating, or transferring vehicles (hereinafter collectively referred to as transferring vehicle ownership):

- The vehicle owner must retain the vehicle registration certificate and license plate (not hand them over to the organization or individual receiving the transfer of ownership) and submit them to the vehicle registration authority for revocation; in the case of transferring vehicle ownership along with a license plate obtained through auction, the vehicle owner must submit the vehicle registration certificate to the vehicle registration authority for revocation.

- Within 30 days from the date of transferring vehicle ownership, the vehicle owner must complete the revocation procedure; if the vehicle owner fails to complete the revocation procedure or hand over the vehicle registration certificate and license plate to the organization or individual receiving the transfer of ownership for revocation within the above timeframe, the vehicle registration authority shall issue a penalty decision against the vehicle owner for the act of failing to complete the revocation procedure as prescribed before resolving the matter.

If the vehicle owner fails to complete the repossession procedure after transferring ownership, they will be held legally responsible for any violations related to that vehicle.

Therefore: When selling a vehicle, the owner must return the vehicle registration certificate and license plate to the vehicle registration authority for revocation procedures, except in cases where the vehicle is sold along with a license plate obtained through auction, in which case the owner must submit the vehicle registration certificate to the vehicle registration authority for revocation procedures.

In other words, from August 15, 2023, the buying and selling of motorcycles and cars will not include license plates, except in cases where the license plates are obtained through auction.

Procedures for revoking vehicle registration certificates and license plates.

The procedure for revoking vehicle registration certificates and license plates is carried out according to Clause 1, Article 15 of Circular 24/2023/TT-BCA, specifically as follows:

- The vehicle owner declares the vehicle registration and license plate revocation form on the public service portal; provides the online vehicle registration file code; submits the revocation application as stipulated in Clause 1, Article 14 of Circular 24/2023/TT-BCA and receives an appointment slip for vehicle registration results as prescribed;

- After verifying the vehicle's valid documents, the vehicle registration authority issues a certificate of registration and license plate revocation as prescribed (with a scratch-off copy of the engine and chassis numbers affixed and the seal of the vehicle registration authority stamped on the scratch-off copies): 01 copy is given to the vehicle owner; 01 copy is kept in the vehicle's file; in case of loss of the vehicle registration certificate, verification will be carried out according to regulations.

Vehicle ownership transfer registration procedures effective from August 15, 2023.

The procedure for registering a change of ownership is carried out according to the provisions of Clause 2, Article 15 of Circular 24/2023/TT-BCA, specifically as follows:

- Organizations and individuals purchasing vehicles: Declare the vehicle registration form as prescribed in Article 9 of this Circular; bring the vehicle for inspection, provide the online vehicle registration file code, and submit the documents as prescribed in Clause 2, Article 14 of Circular 24/2023/TT-BCA;

- After checking the vehicle's documents and confirming that the vehicle is legitimate, the vehicle registration authority will issue a license plate in accordance with Clause 2, Article 12 of Circular 24/2023/TT-BCA;

- Receive the appointment slip for results, pay the vehicle registration fee, and receive the license plate (if a license plate is issued according to the regulations in Point a, Clause 2, Article 12 of Circular 24/2023/TT-BCA); if the vehicle owner wishes to receive the vehicle registration results via public postal service, they should register with the public postal service provider.

- Receive the vehicle registration certificate and license plate (in cases where a license plate is issued according to the provisions of Point b, Clause 2, Article 12 of Circular 24/2023/TT-BCA) at the vehicle registration agency or from a public postal service unit.
