
According to the Daily Intelligencer, these documents include 70 hours of audio recordings and transcripts of conversations between Biden and ghostwriter Mark Zwonitzer, recorded while Zwonitzer was writing Biden's 2017 memoir.
These recordings were obtained by special prosecutor Robert Hur. Hur was appointed to investigate whether Biden illegally kept classified documents at his home while serving as vice president under Barack Obama from 2009 to 2017.
In May, the Heritage Foundation, a conservative think tank, filed a lawsuit under the Freedom of Information Act seeking access to these documents. Biden's lawyers argued that releasing them would violate his privacy.
According to the Washington Post, the lawsuit states: "Every American, including the current or former vice president, has the right to privacy in the personal conversations they have in the comfort of their own home."
The final episode of the show, Colbert, marked the end of the "Evil Orange Man" era in comedy.
In its final report published in 2024, Hur concluded that Biden had "willfully withheld and disclosed" classified documents, including those related to military policy in Afghanistan, but declined to recommend criminal prosecution.
Hur wrote that Biden's memory appeared "significantly impaired" in both his 2017 interviews with the ghostwriter and subsequent interviews with the special prosecutor. He further argued that, if the case went to trial, Biden might present himself to the jury as "a likable, well-meaning older man with a poor memory."
Concerns about Biden's declining health played a significant role in the 2024 presidential campaign. He withdrew from the race after a disastrous televised debate with Donald Trump.
