"Currently, there is a dispute between us and several individuals and organizations regarding the intellectual property rights of the musical work 'Khúc hát mừng sinh nhật' (Birthday Song) and 5 albums : 'Hạt nhân' (Nuclear), 'Tùng chung' (Tung Chung), 'Tùng thuận' (Tung Thuan), 'Tùng phong' (Tung Phong), and 'Tùng teen' (Tung Teen ). Based on the available documents and evidence, and according to our legal perspective, there are differences in the establishment, exploitation, and management of intellectual property rights for the aforementioned works," Phan Đinh Tùng announced.
He continued: "These issues have led to disputes over ownership, commercial exploitation rights, and revenue sharing rights across multiple international digital music platforms for a long time. In particular, advertising revenue generated from the music video 'Happy Birthday Song' on Phan Dinh Tung's official YouTube channel – during the period when the video achieved significant traffic and commercial exploitation – was temporarily recorded for the relevant party by the platform and revenue distribution system during the dispute."

Phan Đinh Tùng is embroiled in a dispute with a digital music revenue generation company, primarily based on the YouTube platform. The collaboration process involves Phan Đinh Tùng producing the song/album, partnering with a company that uses the YouTube CMS system to enable Content ID and generate digital music revenue. The singer and the company share the profits according to a ratio (usually 7-3, or 6-4, favoring Phan Đinh Tùng).
Phan Dinh Tung's partners are responsible for optimizing the platform to achieve the best revenue results, thoroughly managing Content ID associated with each product to claim revenue, compiling revenue statistics monthly and quarterly, and receiving revenue from the platform before paying artists as agreed.
Therefore, Phan Dinh Tung's revenue has been "held back" by his partner for an extended period. All revenue remains within the system, has not been reconciled, and has not been paid to Phan Dinh Tung according to the contract agreement, if everything is as he posted on social media.
"Over the past period, we have repeatedly taken the initiative to exchange information and respond via email, demonstrating our willingness to engage in dialogue with the desire to find a fair, civilized, and legally compliant solution. However, to date, key issues have yet to reach a final agreement between the parties," the singer said.
Finally, Phan Dinh Tung affirmed that he had remained silent for a long time out of goodwill and respect. However, because the matter had become serious, the singer's side had to make it public to the audience and was ready to take the necessary legal steps in accordance with the law.

However, all they receive are empty promises year after year.
The song "Happy Birthday" alone has generated billions of Vietnamese dong in revenue for Phan Dinh Tung since its release. The original version has garnered over 300 million views on YouTube, not including derivative versions and revenue claimed from platforms that re-uploaded the product. After Phan Dinh Tung spoke out, a large number of fans supported the singer's decisive action to reclaim his rightful rights.
