Residential land and production land are prerequisites for ethnic minorities to stabilize their lives and escape poverty. Therefore, the An Giang Provincial People's Council has just issued Resolution No. 11/2024/NQ-HDND regulating land policies for ethnic minorities in the province.
Accordingly, ethnic minorities who do not have land for community activities in district-level administrative units; individuals who are ethnic minorities and are poor or near-poor households in ethnic minority and mountainous areas according to the decision of competent agencies and individuals are the subjects of application of the Resolution.
Individuals exempted or reduced from land use fees and land rents must reside permanently in the locality where the land is converted for land use purposes or is rented. The arrangement of land for community activities and land rental is based on the existing land fund conditions of the locality and the approved and announced land use plan; ensuring publicity, transparency, and correct targets; supported subjects must use land in accordance with the law.
For ethnic minorities who do not have land for community activities, the district People's Committee will arrange land for community activities associated with a system of cultural and sports facilities, in accordance with customs, practices, beliefs, and cultural identity, ensuring a minimum area of 300 m2/land plot.
For individuals who are ethnic minorities and belong to poor households or near-poor households in ethnic minority and mountainous areas who are entitled to the first land support policy; or have been entitled to the first land support policy according to the law but now have no land or lack of land compared to the limit, they will be exempted from land use fees when changing the land use purpose from other types of land that are being used legally to residential land within the land allocation limit prescribed by the Provincial People's Committee. At the same time, they will be entitled to a 50% reduction in land rent when the State leases non- agricultural land that is not residential land for production and business under programs, plans, projects, and land support plans for production and business.
The funding source for implementing the Resolution is implemented according to the provisions of Clause 3, Article 8 of Decree No. 102/2024/ND-CP dated July 30, 2024 of the Government detailing the implementation of a number of articles of the Land Law.
