New regulations on tutoring and supplementary classes.

The Minister of Education and Training (MOET) issued Circular No. 19/2026/TT-BGDĐT amending and supplementing a number of articles of Circular No. 29/2024/TT-BGDĐT dated December 30, 2024, of the Minister of Education and Training regulating supplementary teaching and learning.

The Ministry of Education and Training stated that Circular No. 19/2026/TT-BGDĐT was developed based on feedback and impact assessments from localities, teachers, parents, and society to refine the legal framework, ensuring feasibility, transparency, suitability to actual conditions, and meeting management requirements in the new phase. The Circular takes effect from May 15, 2026.

Defining the boundary between tutoring, supplementary classes, and additional educational activities.

The new circular has been revised to be comprehensive, consistent, transparent, and in accordance with the law.

Circular No. 19/2026/TT-BGDĐT continues to not prohibit legitimate tutoring and supplementary classes; it does not restrict the legitimate learning needs of students or the teaching rights of teachers. The central objective of the Circular is to tighten discipline, prevent illegal, coercive, or profiteering tutoring, and protect a healthy and equitable educational environment in access to education for all relevant parties.

The new circular clarifies the concept of tutoring and supplementary learning, defining the boundaries between tutoring and supplementary learning and other permitted educational enhancement and support activities aimed at the holistic development of students, in accordance with Resolution 71-NQ/TW on breakthroughs in education and training development and Resolution 57-NQ/TW on breakthroughs in science , technology, innovation, and national digital transformation.

Accordingly, the new Circular stipulates that educational activities related to culture, arts, sports; enhancing foreign language proficiency, STEM/STEAM education, digital literacy education, artificial intelligence (AI), career guidance education, life skills education, and other educational content as prescribed to provide holistic education that meets the needs, interests, and talents of students, and which are not included in the curriculum of subjects issued by the Minister of Education and Training, are not within the scope of this Circular and shall be implemented according to other provisions of the law.

Establish a hotline to receive feedback at all levels of management.

Circular No. 19/2026/TT-BGDĐT emphasizes the need for strict control over teachers' extracurricular tutoring activities in accordance with the code of conduct, ethical standards, and prohibited actions for teachers as stipulated in the Law on Teachers. Teachers providing extracurricular tutoring outside of school must ensure transparency regarding content, location, time, and related relationships to prevent conflicts of interest.

The regulation continues to stipulate that each subject should not have more than 2 extra lessons per week. However, this Circular grants principals more autonomy in organizing extra lessons at their schools by proposing to the Director of the Department of Education and Training to allow an increase in extra lesson time for certain student groups as prescribed, along with accountability.

The principal is responsible for managing, monitoring, reminding, and specifying the contents related to teachers in the regulations on tutoring and supplementary classes within the code of conduct for teachers issued by the principal within their authority; handling or recommending handling of violations, ensuring that illegal tutoring does not occur for an extended period or become complicated within their management scope.

The circular requires extracurricular tutoring centers to publicly and fully disclose information about the program, duration, list of teachers, and fees to ensure transparency and enhance social oversight.

In addition, the Circular also stipulates the establishment of hotlines at all levels of management, from schools and commune-level People's Committees to the Department of Education and Training, in order to promptly receive and handle feedback from students, parents, and the public.

Inspections and audits of tutoring activities are conducted according to the principles of transparency, objectivity, and within the proper authority; promptly detecting and handling violations in accordance with the law. The circular clearly stipulates strict penalties for cases of deliberate violations, repeat offenses, or acts of coercion and profiteering in tutoring activities.
