The regulation on the auction of vehicle license plates in the draft Law on Road Traffic Order and Safety is appropriate.

On the morning of March 27, 2024, under the direction of Vice Chairman of the National Assembly Nguyen Khac Dinh, the 5th Conference of full-time National Assembly deputies discussed the draft Law on Road Traffic Order and Safety (TTATGT), one of the issues that many delegates were interested in, which was the regulation on vehicle license plate auctions.

Regarding this content, delegate Nguyen Minh Tam ( Quang Binh delegation) said that the Government's report showed that the implementation of Resolution No. 73/2022/QH15 of the National Assembly in the recent past has brought positive results, proving the effectiveness and feasibility of vehicle license plate auctions. Therefore, it is necessary to legalize the regulations on vehicle license plate auctions in the Road Traffic Safety Law, combined with the issuance and management of vehicle license plates according to identification codes to contribute to administrative procedure reform, meet the goals of digital citizens, digital government and effectively exploit and manage public assets.

"Therefore, I agree with the plan to include the content of the vehicle license plate auction in the draft" - the delegate said and said that the vehicle license plate is identified as a type of public property, so the management of the vehicle license plate is similar to the management of other types of public property. Therefore, this law only regulates the content (type of license plate to be auctioned, starting price, rights and obligations of the auction winner, vehicle registration, auctioned license plate...), while the form (order and procedures for auction) is implemented according to the provisions of the Law on Property Auction, to ensure consistency and synchronization between specialized laws. The delegate also agreed to expand the license plate auction to all road motor vehicles. Delegate Dong Ngoc Ba (Binh Dinh delegation) and delegate Ho Thi Kim Ngan ( Bac Kan delegation) also expressed their agreement with including the provisions of the vehicle license plate auction in the draft Law, and highly appreciated the Government for assessing the impact of this content. Delegate Dong Ngoc Ba suggested additional assessment of social impacts, especially cultural aspects because they relate to the concept of beautiful and ugly numbers and how they affect culture.

"In addition, if auctions are included in this law, the provisions on auctions in the Law on Property Auction must be amended. For example, is the Law on Property Auction inconsistent with this law regarding deposits? Currently, the draft Law on Property Auction has not yet addressed this issue" - the delegate asked.

Delegate Ho Thi Kim Ngan proposed to study, consider, and have a comprehensive, specific, and comprehensive summary of the implementation results of Resolution No. 73/2022/QH15 on pilot auction of automobile license plates to supplement the draft Law accordingly.

The number plates are considered beautiful by the people.

According to a report on some major issues of the draft Law, the National Defense and Security Committee said that expanding the auction of license plates for transport business vehicles and motorbikes is very necessary. "If we do not promptly include this draft law in the draft law and wait until the end of the pilot implementation period, conduct a summary, and report to the National Assembly, then we will have to carry out the procedures for amending and supplementing the new law, which will be costly and wasteful in terms of both time and budget," the report said.

According to the report, the expansion of license plate auctions for motorbikes and scooters comes from the demand of a large number of people with license plates to buy motorbikes and scooters as they like. Moreover, the number of motorbikes and scooters registered every month is very large, if the license plate auctions for these types of vehicles are expanded, it will greatly increase the revenue for the State budget.

To legalize the content of vehicle license plate auctions according to the opinions of the majority of National Assembly deputies, the Standing Committee of the National Defense and Security Committee designed two options.

Option 1: Add 1 article to the draft Law on Road Traffic Safety (Article 37 of the draft Law has been accepted and revised), in the spirit of inheriting the content of Resolution No. 73/2022/QH15 on pilot auction of license plates with adjustments to overcome difficulties and problems in the process of implementing the above resolution.

Option 2: Add the content of vehicle license plate auction to the draft Law amending and supplementing a number of articles of the Law on Property Auction.

The Standing Committee of the National Defense and Security Committee agreed with option 1, because including the provisions in the draft Law on Road Traffic Safety is consistent with the majority of opinions expressed by National Assembly deputies, and consistent with the scope of regulation of the draft Law on Road Traffic Safety, which is a specialized law.
