The adjustment of this law ensures better alignment with the two-tiered local government model, while also demonstrating a proactive approach to bridging the gap between policy and implementation practice by incorporating changes in social life.
According to the Law on the Promulgation of Legal Documents, when drafting laws, broad consultation is necessary, especially with those directly affected. In reality, some draft laws seem to have not solicited opinions widely enough, being posted on electronic portals and at a few specialized workshops within a short period. Therefore, many industry associations, businesses, and citizens – who will be directly affected – may not have had time to provide in-depth feedback. On another aspect, impact assessment reports are crucial to ensuring that policies are scientifically sound and feasible. However, some reports do not adequately quantify compliance costs, implementation risks, or negative impacts; the data used in these reports is often outdated. In some cases, the reports do not even truly serve as a basis for policy adjustments.
International experience shows that, after soliciting feedback, drafting agencies usually publish a summary of comments and explanations for accepting or rejecting them. This regulation has also been implemented in Vietnam, but its application has not been consistent across some draft laws. In emerging fields such as the digital economy , green energy, or artificial intelligence, the rapid pace of change means that any long-term impact assessment carries a significant "lag."
To bridge the gap between feedback and legislation, many experts suggest we should resolutely change three key areas. Firstly, consultations must target the right groups affected, with sufficient time and diverse methods. Secondly, comprehensive impact assessments must be conducted, considering both costs and benefits, and updated according to the latest market and societal developments. Thirdly, a feedback and accountability mechanism must ensure that all feedback is considered and receives a clear response.
When that is achieved, the law will truly "last," becoming an effective management tool, while simultaneously building trust and consensus within society.
