Six years of reorganizing the state apparatus Part 1: Perfecting the apparatus organization

On October 2, 2023, the Politburo issued Conclusion No. 62-KL/TW on the implementation of Resolution No. 19-NQ/TW dated October 25, 2017 of the 12th Party Central Committee on continuing to innovate the organizational and management system, improving the quality and efficiency of public service units. Organizing and restructuring public service units (Resolution 17) and restructuring the apparatus of the political system (Resolution 18) is a major and important issue.

The Politburo's conclusion is the latest directive on innovating the organizational system and improving the quality of public service units nationwide, after 6 years of implementation, since October 2017. Together with the whole country, how has Tay Ninh implemented the two resolutions mentioned above over the past 6 years?

After 6 years of implementing Resolution No. 18-NQ/TW, the Provincial People's Committee has issued decisions on the functions, tasks, powers, and organizational structure of 19/19 provincial-level administrative agencies and organizations, and the Standing Committee of the Provincial People's Council has issued decisions regulating the functions, tasks, powers, and organizational structure and apparatus of the Office of the National Assembly Delegation and the Provincial People's Council. At the district level, the People's Committees of districts, towns, and cities promptly issued the functions and tasks of 11/11 specialized departments after receiving instructions from the Provincial People's Committee.

Reducing professional agencies at district level

The organizational structure of agencies, administrative organizations and public service units (as of June 30, 2023) has also undergone changes and adjustments.

For provincial-level administrative agencies and organizations, there are 20 provincial-level administrative agencies and organizations, unchanged compared to 2017. Internal organizations have 110 departments, offices, branches and equivalents under provincial-level administrative agencies and organizations (a decrease of 40 organizations compared to 2017 and unchanged compared to June 30, 2022).

At the district level, there are 9 district-level administrative units, unchanged from 2017. At the district level, there are 99 specialized agencies, a decrease of 9 specialized agencies (9.17%) compared to 2017 due to the dissolution of the Health Department, transferring the state management task of the health sector to the Office of the People's Council and the People's Committee at the district level.

At the commune level, Tay Ninh currently has 94 commune-level administrative units including 71 communes, 17 wards and 6 towns, reducing 1 commune due to the merger of Phuoc Luu commune and Binh Thanh commune into Phuoc Binh commune.

For public service units: As of June 30, 2023, the whole province has 521 units, a decrease of 124 units compared to 2017 and a decrease of 11 units compared to June 30, 2022. Of which, there are 7 public service units under the Provincial People's Committee, a decrease of 3 units compared to 2017.

There are 76 public service units under provincial departments, branches and sectors (101 units in 2017 but 78 units by June 30, 2022). There is one public service unit under another administrative organization under the Provincial People's Committee (none in 2017). There are no public service units under branches under specialized agencies under the Provincial People's Committee (11 units in 2017). There are 437 public service units under the District People's Committee (523 units in 2017, 446 units by June 30, 2022).

Implementing the Notice of Conclusion No. 16-TB/TW dated July 7, 2022 of the Politburo on implementing a number of pilot models according to Resolution No. 18-NQ/TW of the 6th Central Conference, term XII, including piloting a new model on organizational structure, the Provincial People's Committee has piloted the transfer of functions and tasks of advising on administrative reform, the Standing Committee of the Provincial Administrative Reform Steering Committee from the Department of Home Affairs to the Provincial People's Committee Office and the transfer of functions and tasks of advising on ethnic affairs from the Provincial People's Committee Office to the Department of Home Affairs. However, on July 4, 2023, the Provincial People's Committee decided to stop the pilot implementation of the above two contents.

Piloting concurrent positions

The concurrent holding of some leadership and management positions mainly includes the positions of Provincial Party Secretary and Chairman of the Provincial People's Council. District Party Secretary and Chairman of the District People's Council, Deputy District Party Secretary and Chairman of the District People's Council, Heads of Party Committees and Heads of Provincial and District People's Councils; Party Committee Secretary and Chairman of the People's Council at the commune level (37/94 communes, wards and towns), Deputy Party Committee Secretary and Chairman of the People's Council at the commune level (51/94 communes, wards and towns), and Commune Party Committee Secretary and Chairman of the Commune People's Committee (4/94 communes).

The arrangement of concurrent positions of officials, according to the assessment, has "helped reduce the number of focal points, save the state budget, help agencies with similar tasks to be more proactive in performing their professional duties, ensure the leadership role of the Party Committee and the effectiveness of management and operation of the grassroots government; is a breakthrough in the process of arranging and perfecting the organizational apparatus".

Streamlining staff

Implementing staff streamlining, from 2014 to mid-2023, Tay Ninh has 869 cases, of which, from 2015 to June 30, 2022, there are 814 cases. From June 30, 2022 to June 30, 2023, there are 55 cases subject to streamlining and have been streamlined.

Regarding the number of deputies, the province will arrange deputies according to the provisions of Decree No. 107/2020/ND-CP and Decree No. 108/2020/ND-CP of the Government. Accordingly, for the provincial level, on June 17, 2021, the Provincial People's Committee issued Decision No. 1294/QD-UBND on the project to arrange the number of deputies of heads of departments and organizations and units under the department. According to the project, the number of deputies arranged for 18 provincial-level professional agencies is 50 people, ensuring compliance with the provisions of Decree No. 107/2020/ND-CP and 4 reserve deputies arranged for large-scale, multi-sectoral management departments, the number of deputies of organizations under the department is 121 people. By June 30, 2023, the number of deputies at professional agencies under the Provincial People's Committee is 48 people/18 professional agencies. The number of deputy heads of the organization under the department is 110 people, ensuring compliance with the regulations according to the province's project and Decree No. 107/2020/ND-CP.

For the district level, 9/9 districts, towns and cities have issued a project on the number of deputies according to Decree No. 108/2020/ND-CP of the Government. The number of deputies at specialized agencies under the People's Committee at the district level as of June 30, 2023 is 158 people (an average of 1.59 people per specialized agency), ensuring compliance with the provisions of Decree No. 108/2020/ND-CP.

After 6 years of implementing Resolution No. 18-NQ/TW, agencies, units and localities in the province have deployed and organized the implementation synchronously, seriously, closely, with focus, key points, and a suitable roadmap with many good and creative ways of doing things, promoting the role of each agency, unit and locality, achieving important initial results, creating positive changes in the process of implementing the restructuring of the apparatus towards streamlining, effective and efficient operations.

Tay Ninh promptly issued documents regulating the functions, tasks, and powers of specialized agencies and public service units, overcoming the situation of duplication and overlap in functions, tasks, and management areas of agencies and units, ensuring that only one agency is assigned to take charge of a task.

The arrangement and consolidation of the state administrative apparatus and public service units are always regularly implemented. Agencies, units and localities regularly review and arrange the organizational structure within the agency towards streamlining, effective and efficient operations. Public service units continue to be reviewed, consolidated, merged and dissolved so that in the period of 2021-2025, the number of public service units will continue to be reduced by 10% compared to 2021.

Income is not enough to cover expenses

Most agencies and units have shown determination and initiative in implementing Resolution No. 18-NQ/TW and Plan No. 65-KH/TU. However, some agencies and units are still waiting for the Central Government's decrees and circulars, so the progress of restructuring the apparatus is still slow. The restructuring of the apparatus will affect the civil servants and officials leading the agencies and units, but the Central Government does not have a support policy for these subjects, which partly affects the organization and implementation of the restructuring.

Tay Ninh recommends that central ministries and branches promptly issue guidelines on job positions in administrative agencies and public service units for localities to implement synchronously. Central ministries and branches promptly issue guidelines on developing technical and economic norms for each sector so that localities have a basis for promulgating public service unit prices, creating favorable conditions for localities when developing and approving autonomy plans according to Decree No. 60/2021/ND-CP of the Government regulating the financial autonomy mechanism of public service units. Recommend that the Ministry of Finance provide guidance on the mechanism for compensating for insufficient revenue for local public service units, promptly providing guidance on developing autonomy plans for each type of service unit according to the provisions of Decree No. 60/2021/ND-CP.
