Amending the Law on Higher Education to improve the quality of human resources

GD&TĐ - The Ministry of Education and Training is seeking comments on the draft Law on Higher Education (amended) to modernize higher education and improve the quality of human resources.

The Ministry of Education and Training said that the Law on Higher Education 2012 (Law No. 08) issued in 2012 and amended and supplemented in 2018 (Law No. 34) has created a legal corridor to expand autonomy for higher education institutions (HEIs) to gradually improve training quality and meet the human resource needs of the economy, promoting competition to promote socialized educational resources.

However, after more than 13 years of implementing Law No. 08 and 6 years of applying Law No. 34, in addition to the achieved results, the actual implementation of the Law on Higher Education also encountered some difficulties and obstacles; including causes from awareness, capacity of implementation and limitations while the Law on Higher Education has many new policies and regulations;

The system of legal documents related to the operation of higher education institutions has not been completed synchronously. Some provisions of the Law on Higher Education are still inadequate, have not fully promoted the role of implementing democracy of socio -political organizations, are not suitable to reality and do not keep up with the requirements of economic and social development in the new context of the country.

Therefore, amending the Law on Higher Education is necessary to fully institutionalize the major policies of the Party and the Government in recent years. At the same time, the Law on Higher Education (amended) will create a legal basis to remove difficulties and obstacles in the implementation of the current Law on Higher Education; overcome limitations in training quality, university governance, autonomy, finance, digital transformation and international cooperation.

Thereby, contributing to the modernization of higher education, improving the quality of human resources, promoting sustainable development and making Vietnamese education a center of knowledge and science and technology in the era of national development.

Draft Law adds many new contents

Regarding the group of issues on university governance: The draft adds higher education institutions that are not subject to state management under the current Law (research institutes, training schools, academies with undergraduate and postgraduate training activities) to become subjects of application of the Law to ensure state management of higher education and training quality.

Supplementing regulations on the rights and duties of the school board and principal; the authority to appoint, transfer, rotate, and dismiss the chairman of the school board and principal to increase unified and effective command and management, overcome existing shortcomings in the relationship between the school board and the board of directors, and strengthen the leadership of the Party.

Regarding the group of issues on training activities: The draft supplements digital education, training by order, assignment; digital education training, training program standards; supplements regulations on approving doctoral training programs to anticipate new educational technologies and develop human resources to serve the task of socio-economic development, providing human resources for key scientific fields, key engineering technologies; accessing modern educational technology, increasing university autonomy; improving the quality of doctoral training.

Supplementing regulations on technology application, expanding higher education activities in digital space to organize online training activities and apply technology in teaching and learning; ensuring training quality, linking and cooperating in training, sharing and common use of resources among higher education institutions in digital space.

Group of issues on scientific research and innovation: Add new content identifying higher education institutions as the center of the national innovation ecosystem; linking schools - businesses - localities.

Group of issues on lecturers and learners: Supplementing policies to develop excellent lecturers and scientists, specific policies for leading scientists; mechanisms for treating and attracting domestic and foreign talents, linked to research effectiveness and international publications. This proposal aims to promote university autonomy of educational institutions to hire excellent lecturers and scientists.

Quality assurance and accreditation issues: Supplementing a comprehensive approach towards quality management, output results, developing a quality culture in higher education institutions; innovating the quality assessment and monitoring mechanism associated with open and transparent data standards.

Integrate conditions to ensure training quality in regulations on registration of training activities in the digital environment; assign the Minister of Education and Training to prescribe and guide detailed professional contents in training regulations.

Group of issues on assets and finance: Grant autonomy to public higher education institutions in mobilizing and using non-budgetary resources. Incentives on land, tax, credit for educational institutions and cooperation activities, investment and funding for higher education to solve problems related to procedures for land grant for investment in education; overcome the increase in training costs, leading to increased tuition fees for learners due to taxes.

Cut down and simplify administrative procedures

The draft proposes to merge four procedures including establishing a branch, permitting operations, and resuming operations of a university and a branch into one procedure for registering operations.

Consolidate 2 procedures including licensing the operation of foreign-invested higher education institutions and branches of foreign higher education institutions into 1 procedure for registering the operation of foreign-invested higher education institutions. Consolidate 3 procedures including approving, extending, and terminating joint training activities into 1 procedure for registering the implementation of joint training programs.

According to the draft, the Government issues general inter-sectoral and inter-ministerial issues; issues related to the nation.

The Ministry of Education and Training grants the authority to establish, dissolve, name, and rename higher education institutions; prescribes criteria for appointing professors and associate professors; and promulgates a list of training majors.

Local authorities manage the state on higher education at the local level according to decentralization and delegation of authority.

Higher education institutions are given the highest level of autonomy in professional activities, organization, personnel, finance, and assets.
