For the 2 land fill mines at Cha Ray Mountain, An Nhon Town (Binh Dinh Provincial People's Committee granted mining licenses to serve the construction of the project of the connecting road from An Nhon Town Center to the coastal road west of Thi Nai Lagoon and the project of Area 1, residential area along National Highway 19 (new) Phuoc Loc Commune, Tuy Phuoc District), Binh Dinh Provincial People's Committee assigned the Provincial Site Clearance Board and the Provincial Traffic Project Management Board to request enterprises to seriously carry out mining according to the license; implement environmental protection measures, water the public roads, cover materials during transportation to avoid spillage, dust, environmental pollution, affecting the lives of people in the area; if not implemented well, causing complaints and lawsuits, the investor and the mine owner must be responsible for explanation and be responsible before the law.
The Chairman of the Provincial People's Committee assigned the Department of Natural Resources and Environment to organize inspections and request enterprises exploiting soil and filling materials in the above-mentioned area to seriously and fully implement the contents of the Environmental Impact Assessment Report approved by competent authorities and legal regulations related to environmental protection; in which, urgently complete the contents of settling tanks, rainwater collection and drainage systems, and embankments before the rainy and flood season to avoid the risk of landslides, ensure safety, and not affect the travel and cultivation of people and neighboring areas; at the same time, request enterprises to install notice boards in the exploitation area to publicize the information of the Exploitation License for functional agencies, authorities and people to monitor and supervise.
For the area of sand exploitation and recovery for common construction materials during the implementation of the Kon River Dredging project from Phu Phong dam to Hoa Lac block, Phu Phong town and Tay Phu commune, Tay Son district (licensed to Hieu Ngoc General Construction Company Limited), the People's Committee of Tay Son district shall preside over and coordinate with the Provincial Traffic Project Management Board and the Department of Natural Resources and Environment, the Department of Agriculture and Rural Development, and the Department of Construction to publicize the Kon River Dredging project from Phu Phong dam to Hoa Lac block, Phu Phong town, Tay Phu commune and the sand exploitation and recovery in areas 1 and 3 of the above project to serve the construction of the DT.639 coastal road for agencies, units and people to know and participate in supervision.
Coordinate with the Traffic Project Management Board of Binh Dinh province to urge Hieu Ngoc General Construction Company Limited to urgently organize the development of a specific plan for dredging and sand exploitation to clear the flow in phases and develop a plan to respond to natural disasters and ensure safety in the mine area during sand exploitation activities to submit to the competent authority for appraisal according to regulations.
Deposit for road maintenance and infrastructure repair during mineral transportation, ensure appropriate density and frequency of transportation, correct load to avoid affecting people's lives and local traffic infrastructure; use sand transport vehicles must have construction signs, install journey monitoring and data storage devices, and provide information on the travel itinerary of the vehicle, equipment used to mine and transport sand and gravel for monitoring by authorities, local authorities and people.
Establish a team to inspect and supervise the above-mentioned mining activities, ensure that the mining is carried out in accordance with the mining plan and environmental impact assessment report approved by competent authorities; be responsible to the Chairman of the Provincial People's Committee if there is any illegal mining, not in the right location or coordinates for the above-mentioned project in particular and in Tay Son district in general.
The Binh Dinh Provincial Traffic Project Management Board requests the construction unit to seriously install card swiping devices for vehicles entering and exiting the sand mining and dredging areas and vehicles transporting sand for construction works; take measures to count and monitor the number of vehicles transporting sand and the volume of sand for construction works; ensure the use of sand in accordance with the purpose of serving traffic works approved by the Provincial People's Committee; be responsible before the Chairman of the Provincial People's Committee if the exploited volume is used for the wrong purpose, causing loss of resources.
For the 4 soil mines at TDTS27 mine site, Binh Nghi commune, Tay Son district to serve the construction of the North-South expressway project, it is recommended that Project Management Board 85 preside over and coordinate with local authorities and functional departments of the province to work with contractors who have been approved to exploit in the above area to unify the route for transporting soil and filling materials, avoiding dust, environmental pollution, and affecting the lives of people in the area during the process of exploiting and transporting soil.
Regarding the sand mine used as common construction materials during the implementation of the Phu Phong Dam project, Tay Son district has granted a license to Construction Joint Stock Company 47, assigned the Provincial Traffic Project Management Board (investor of the Cat Tien - Diem Van coastal road project) and the Provincial Agriculture and Rural Development Project Management Board (investor of the Thanh Hoa 1 dam project under the Tan An - Dap Da irrigation system project) to strictly organize the supervision and acceptance of the volume for Construction Joint Stock Company 47, and send it to the Department of Natural Resources and Environment for coordination in monitoring and management according to regulations.
Regarding the sand mine for common construction materials on Kon River, Tay Xuan Commune, Binh Hoa Commune, Phu Phong Town, Tay Son District has granted a license to Phu Hung Ha Noi Investment Joint Stock Company, assigned the Department of Natural Resources and Environment to urgently preside over and coordinate with the Provincial Tax Department, Tay Son District People's Committee and relevant functional units to organize a specific inspection of the actual exploited volume (including the sand reserves that the enterprise is gathering along the riverbank), compare data and documents with the tax authority compared to the licensed volume according to License No. 154, dated November 28, 2022, proactively handle according to legal regulations, report and propose to the Provincial People's Committee before October 10, 2023.
Regarding the Ha Thanh River flow regulation project, the People's Committee of Van Canh district shall take the lead in resolving all difficulties and promptly implementing the Ha Thanh River flow regulation project in Hien Dong village, Canh Hien commune, Van Canh district; at the same time, take measures to warn and notify households with land and property to comply with the plan to prevent landslides and natural disasters in the Ha Thanh River area.
Direct relevant departments, offices and commune-level People's Committees to regularly organize inspections and supervision of mineral exploitation activities in the area (especially at mines in Canh Vinh and Canh Hien communes) to promptly detect, prevent and handle violations according to law.
Urgently organize inspections, review and strictly handle the situation of land encroachment, illegal construction; construction of works, houses, temporary houses, barns on agricultural land, and improper land use, especially in the Ha Thanh river area in Canh Hien and Canh Vinh communes; request self-demolition or handling of dismantling, completion time before December 10, 2023; report the implementation results to the Provincial People's Committee before December 15, 2023.
Regarding the Department of Natural Resources and Environment, the Provincial People's Committee requests to preside over and coordinate with relevant agencies to continue to strengthen inspection and examination work to rectify mineral exploitation activities in the province, resolutely handle violations according to current legal regulations; urgently coordinate with the Department of Information and Communications to deploy a mineral exploitation monitoring system with cameras (with the function of counting the number of vehicles) connected from cameras in the exploitation areas of enterprises to relevant agencies to serve the management and inspection work to promptly detect, prevent and handle cases of exploitation exceeding capacity, exploitation at night, and not at the prescribed time.
Strengthen the State management function in the field of minerals; monitor, urge and closely coordinate with departments, branches and localities to effectively implement the above contents; promptly report and propose to the Provincial People's Committee according to regulations.
The Chairman of the People's Committee of Binh Dinh province assigned the Provincial Police to direct the An Nhon Town Police and the Tay Son and Van Canh District Police to closely coordinate with local authorities and relevant agencies to promptly detect and handle violations of mineral exploitation and environmental protection in mining areas; strengthen patrols on roads under their management, strictly handle vehicles transporting soil and sand as construction materials that violate load regulations when participating in traffic, vehicles that drop construction materials, vehicles with extended beds to carry goods, vehicles transporting wet sand that let water flow onto the road surface, causing damage to traffic infrastructure, potential traffic safety risks, and affecting environmental sanitation.
