Ensure a healthy competitive environment
On May 10, speaking at the discussion on some contents with different opinions of the draft Law amending and supplementing a number of articles of the Law on Advertising, delegate Trinh Lam Sinh - National Assembly Delegation of An Giang province said that the draft Law amending and supplementing a number of articles of the Law on Advertising had been adjusted by the drafting agencies with many contents commented on at the 8th session.
To contribute to completing the draft law, delegates contributed a number of issues:
Regarding general issues, according to the delegate, Vietnam is currently a dynamic, high-growth economy with a high rate of Internet and social network users. This is a good environment for advertising activities, especially online activities, with conditions for development and is currently developing at a dizzying speed, becoming an indispensable communication channel for businesses and still has room for development.

Looking at the overall growth of the economy, it is undeniable that advertising, including online advertising, has brought many advantages, such as more precise targeting, more effective measurement, easier, more flexible costs and especially selling more products.
However, the delegate said that the rapid growth has made advertising activities lack transparency and are quite difficult to control, which is a matter of concern. Because the lack of regulations and effective control mechanisms has led to many shortcomings, such as false advertising, dirty advertising, toxic content spreading on the internet, lack of censorship, causing negative impacts on awareness, especially among young people.
The collection and use of user data for advertising is sometimes not transparent and violates privacy. Many businesses use misleading advertising tricks for the purpose of unfair competition and attracting customers.
"On the user side, especially those who regularly use the Internet, they are increasingly annoyed by the large number of ads that appear densely, interrupting the online experience. I myself am also very frustrated when I use software every day to serve my work or watch the news and get interrupted by online ads. There are ads that last up to 30 seconds, 50 seconds, there are news articles with 4-5 ads that take up the entire image, have to be removed, but sometimes they cannot be removed, the ads keep interrupting, which is very annoying.
The above issues show that the promulgation of a law amending and supplementing a number of articles of the Advertising Law is very necessary, helping to create a more solid legal framework to manage the advertising market, ensure a healthy competitive environment, and at the same time protect the interests and rights of both businesses and consumers," the delegate said.
Review specific regulations on words, voices, and writings that are not allowed to be used in advertising products.
Second, on specific issues in Article 8. According to the delegate, in Clause 8, Article 1 of the draft, that is, Point b, Clause 2, Article 15a on the rights and obligations of the person transmitting advertising products, there is a provision "Providing documents related to advertising content when requested by competent state agencies".
According to the delegate, this is the obligation of the advertiser, the advertiser must be responsible for providing truthful and accurate information to the advertiser, and at the same time provide documents related to the advertising content when requested by the competent state agency. Therefore, the above regulation on the rights and obligations of the advertiser is not completely consistent with Clause 1 of Article 15a, it is proposed that the Drafting Committee study and review.

In Clause 10, Article 1 of the draft, that is, Clause 1, Article 18 stipulates that "Vietnamese words in advertising products must ensure the purity of Vietnamese, be clear, easy to understand and accurately express the content to be conveyed". According to the delegate, currently Vietnamese society is developing very well, advertising activities and advertising programs use many words that are both strange, sensitive and very diverse. At the 8th session, a number of National Assembly delegates spoke on this issue.
Therefore, delegate Trinh Lam Sinh proposed to assign this task to the Government or prescribe to ministries and branches to review specific regulations on words, voices, and writings that are not allowed to be used in advertising products. Only then can we flexibly adjust and supplement and help localities have a basis for assessing and licensing content related to voices and writings in advertising.
Similarly, in Clause 14, Article 1 of the draft, that is, the clauses of Article 22 stipulate the duration of advertising for different types of advertising. According to the delegates, the law will have difficulty keeping up with the ways of using the duration of different types of advertising. At the 8th session, many delegates were concerned and mentioned this issue a lot.
Delegate Trinh Lam Sinh proposed that this task should be assigned to the Government or assigned to ministries and branches to advise the Government to regulate the advertising duration, both to implement the direction of the National Assembly Chairman in Official Dispatch No. 15 dated October 29, 2024 on innovation in thinking in law-making and also to help us be flexible and timely to adjust and supplement when necessary, helping advertising activities always develop healthily.
"From the above issues, I propose that the Drafting Committee should study and review and assign the Government to make regulations in order to promptly amend and supplement other contents in the draft. Because the advertising market is very diverse and creative, constantly innovating, if the regulations are too detailed in the law, we will have difficulty in managing, adjusting or handling," the delegate suggested.
