Removing obstacles in the enforcement of civil judgments.

Civil enforcement work in the province has faced numerous difficulties recently. The number of cases is increasing, their nature is becoming more complex, and many cases involve very large sums of money to be enforced. The parties involved often only possess a single asset, such as land and houses, which is of little value compared to the amount to be enforced. Cases related to the handling of fishing vessels under Government Decree No. 67/2014/ND-CP dated July 7, 2014, have seen their value significantly reduced compared to the time the bank appraised them for loans. The real estate market is struggling; many properties, including land and houses, have been seized and auctioned off by enforcement agencies, with prices repeatedly reduced but still without buyers. The level of compliance with judgments and decisions among those obligated to comply is low, with many cases of non-voluntary enforcement; and the abuse of the right to appeal and denounce to prolong the enforcement process is also a concern.

Comrade Le Chi Linh, Deputy Director of the Provincial Civil Judgment Enforcement Department, stated: Recognizing the difficulties and obstacles, the Party Committee and leadership of the Provincial Civil Judgment Enforcement Department have focused on directing units within the sector to strictly implement the Party's guidelines and policies, and the State's laws on civil judgment enforcement and administrative judgment enforcement; proactively developing work plans that are appropriate to the specific circumstances of each unit; and regularly urging and directing the Civil Judgment Enforcement Sub-departments in districts and cities to fulfill assigned targets and tasks. In addition, the Provincial Civil Judgment Enforcement Department continues to consolidate and streamline its organizational structure; strengthen administrative discipline and order; and focus on improving professional qualifications and training skills for enforcement officers throughout the sector. The Provincial Enforcement Department has completed the reorganization of the Nam Dinh City and My Loc District Enforcement Sub-departments in accordance with Resolution No. 1104/NQ-UBTVQH15 dated July 23, 2024, of the Standing Committee of the National Assembly on the reorganization of district and commune-level administrative units in the 2023-2025 period of Nam Dinh province, ensuring that the newly established Nam Dinh City Enforcement Sub-department operates stably and effectively.

Regarding operational activities, the Provincial Enforcement Department regularly monitors and closely tracks the progress of case resolution, and the plan for definitively handling large-value cases by units throughout the province, especially the review, verification, and accurate classification of cases and funds eligible for enforcement, and the procedures for asset valuation and auction, ensuring strict adherence to legal regulations. It continues to effectively guide and direct the work of the Sub-departments, ensuring strict implementation of operational guidance procedures and enforcement organization procedures. Simultaneously, the Provincial Enforcement Department focuses on directing the definitive resolution of enforceable cases, especially large-value cases and cases involving the recovery of funds and assets in criminal cases related to corruption and economic crimes, particularly those under the supervision and direction of the Central Steering Committee and the Provincial Steering Committee for the Prevention and Control of Corruption, Waste, and Negative Practices. To ensure the effective recovery of assets seized or lost in criminal cases related to corruption, the Provincial Enforcement Department has proactively developed a plan to direct the organization of enforcement and issued documents to implement Directive No. 04-CT/TW dated June 2, 2021, of the Party Central Committee on strengthening the Party's leadership over the recovery of assets seized or lost in criminal cases related to corruption and economic crimes in a detailed, focused, and targeted manner. Closely following the tasks, the units directed enforcement officers to promptly and intensively verify and locate assets; handle assets subject to security measures and seizure measures; and definitively enforce criminal cases related to corruption and economic crimes that are eligible for enforcement. The Provincial Enforcement Department established a working group to conduct a thematic inspection of all 10 district and city-level Enforcement Departments regarding the handling of enforcement cases related to corruption and violations of economic management regulations. In addition, the Provincial Enforcement Department strengthened coordination with functional agencies such as the Provincial Police, the Provincial People's Court, the Provincial People's Procuracy, the Social Insurance agency, and the State Bank of Vietnam... to promptly amend and supplement inter-agency coordination regulations to address difficulties and obstacles for localities, contributing to accelerating the resolution of cases; and closely coordinated with prosecuting agencies in verifying information and applying measures to seize, confiscate assets, and freeze accounts in criminal cases involving corruption and economic crimes... As a result, the recovery of misappropriated or lost assets in criminal cases involving economic crimes, corruption, and abuse of power has achieved high results in terms of both the number of cases and the amount of money recovered. In 2024, the provincial enforcement agencies completed 98 out of 135 enforceable cases, achieving a rate of 72.6%; and collected over 168 billion 171 million out of 179 billion 585 million VND, achieving a rate of 93.64%.

With decisive and appropriate solutions, the activities of the provincial enforcement agency have been undergoing positive changes, with many complex and protracted cases being resolved. In the first six months of 2025 (the year of enforcement begins in October 2024), the provincial enforcement agency completed the enforcement of 2,416 out of 4,301 enforceable cases, achieving a rate of 56.17% of the annual plan compared to the target of 84.05% assigned by the General Department of Enforcement. Regarding monetary amounts, over 160 billion 756 million VND out of 914 billion 909 million VND enforceable cases have been collected, achieving a rate of 17.57% of the annual plan compared to the target of 52% assigned by the General Department of Enforcement. Enforcement agencies in the province also issued decisions to apply coercive enforcement measures in 24 cases, and have carried out enforcement in 11 cases. All enforcement cases were conducted safely and successfully. These results are an important foundation for the provincial enforcement agency to achieve its targets, tasks, and work plans for 2025, and contribute significantly to maintaining political stability and social order in the province.
