Doan and Dung in court |
At about 4:00 p.m. on May 18, 2022, Nguyen Van Doan, Pham Van Dung, Nguyen Minh Thao and Nguyen Van Dieu sat down to drink at a restaurant in Phu Cuong Xuyen village, Loc Thuy commune. Dung forced Dieu to drink beer but Dieu refused, leading to Dung and Dieu arguing. Seeing this, Doan and Thao intervened, Thao took Dung to Mr. Nguyen Van L.'s house, about 100 meters from Ms. Bich's restaurant, then returned to continue drinking beer.
A while later, Doan and Thao argued about Dung forcing Dieu to drink beer, then the two sides argued and challenged each other to a fight. Thao threw a beer bottle at Doan. Doan ran to his motorbike to get a knife. Thao saw this and ran to Mr. L's house but was chased by Doan. When they reached Mr. L's yard, Thao and Doan got into a fight. Thao was slashed in the right hand by Doan. At the same time, Dung was sitting drinking tea, saw Doan and Thao fighting, so he picked up a porcelain teapot and threw it at Doan's left eye. Doan used his left hand to hold his head, and with his right hand he held a knife and slashed Dung many times, causing injuries to his head and hand, but was later stopped by everyone.
The forensic examination conclusion of the provincial Forensic Center concluded: Nguyen Minh Thao's overall body injury rate was 39%; Pham Van Dung's overall body injury rate was 21%. Doan's actions constituted two crimes: "Murder in a state of extreme emotional agitation" for the act of slashing Dung and the crime of "Intentionally causing injury" for the act of slashing Thao. Dung's act of using a porcelain teapot as a dangerous weapon to throw at Doan's head, causing 7% injury, constituted the crime of "Intentionally causing injury".
The trial of the car was held on April 2. After questioning and reviewing the documents and evidence in the case file, the Trial Panel decided to extend the deliberation.
On April 8, the Trial Panel determined: After the defendant Dung threw the teapot into the defendant Doan's left eye, the defendant Doan covered his eyes with one hand and used the other hand to hold a knife and slashed the defendant Dung's head, causing multiple injuries. However, when examined, those injuries were determined to be superficial lacerations that could not have caused death even if not treated promptly. Above all, the defendant Doan had no motive or intention to kill the defendant Dung.
The Trial Panel found that the prosecution of the defendant Doan for the crime of "Murder in a state of extreme emotional agitation" was incorrect, the defendant Doan's behavior was the crime of "Intentionally causing injury", so it decided to revise the defendant Doan's charges, sentencing defendant Nguyen Van Doan to 3 years in prison for the crime of "Intentionally causing injury"; defendant Pham Van Dung to 6 months in prison for the crime of "Intentionally causing injury" but with a suspended sentence.
