The Ministry of Interior has just responded regarding the calculation of maternity leave time when adjusting salary grades for newly recruited civil servants.
According to reports, Ms. Nguyen Thi Thu Hien ( Hanoi ) was recruited as a civil servant at a secondary school effective July 1, 2025, with the title of Accountant, job code 06.031. Prior to this, she had 12 years and 6 months of experience as an accountant under contract at a public school and had full participation in mandatory social insurance.
During her employment, Ms. Hien took maternity leave three times, totaling 18 months. However, when her salary was being reclassified, she was informed that her maternity leave would not be counted as working time according to regulations for salary classification purposes.
In response to this question, the Ministry of Interior stated that, according to current labor laws, maternity leave is still counted as actual working time and continuous service time for the purpose of receiving benefits such as annual leave, social insurance, and salary increases.
At the same time, according to Decree 85/2023/ND-CP, individuals recruited or appointed as civil servants under this Decree who previously had a period of employment in accordance with the law and paid mandatory social insurance contributions (if not continuous and not having received a lump-sum social insurance benefit, the periods can be added together) will have that period counted as the basis for salary classification according to the professional title appropriate to the position for which they are recruited or appointed, provided they meet all the conditions as prescribed.
Accordingly, the time used as a basis for salary calculation must be appropriate to the job position for which the employee was recruited or hired.
