At the meeting, the Government Standing Committee and delegates discussed and gave opinions on: Draft Law on Execution of Criminal Judgments (amended); Draft Law on Execution of Temporary Detention, Temporary Imprisonment and Prohibition from Leaving Place of Residence; Proposal to develop a Law on Thrift and Anti-Waste; on the implementation of decentralization and delegation of powers associated with the implementation of the 2-level local government organization model to prepare for further reporting to competent authorities.

Regarding the implementation of decentralization and delegation of power associated with the implementation of the 2-level local government organization model, reports and opinions at the meeting said that, implementing the resolutions of the Central Committee and the conclusions of the Politburo, the Government submitted to the 9th extraordinary session of the 15th National Assembly the Law on Government Organization and the Law on Local Government Organization (identified as the 2 original laws of the administrative system), which clearly stipulate the principles of decentralization, decentralization, delegation of power, and authorization.
At the same time, the Law has assigned the Government to issue legal documents with the nature of legislative authorization to resolve priority and urgent issues in implementing decentralization and delegation of power.
Also at the 9th extraordinary session of the 15th National Assembly, the Government submitted to the National Assembly for approval 4 laws and 11 resolutions; and the Government also issued 124 decrees and 52 resolutions under its authority, clearly expressing the viewpoints, goals, principles, requirements, orientations and contents of promoting decentralization and delegation of power (some areas of continuous, thorough and outstanding decentralization and delegation of power include: Investment, investment attraction; innovation of procedures and processes for drafting and promulgating legal documents; organization, payroll; civil servants, public employees...).
Currently, the Government is focusing on directing ministries and branches to continue researching, developing and perfecting 34 draft laws and 11 resolutions to submit to the National Assembly at the ongoing 9th session. At the same time, it is assigning tasks to ministries and ministerial-level agencies to develop and submit to the Government for promulgation of decrees or promulgate them according to their authority to implement decentralization, delegation of power and deploy the organization of 2-level local governments.
After listening to reports and opinions, Prime Minister Pham Minh Chinh assigned Deputy Prime Ministers in charge of the field to directly direct, ministers and heads of ministerial-level agencies to continue to urgently review in the field of management to promote decentralization and further delegation of power to localities, along with appropriate allocation of resources, improving the implementation capacity of subordinates, and designing tools to strengthen inspection, supervision and control of power.
In particular, the Prime Minister noted the need to focus on reviewing the contents of decentralization and delegation of authority related to the budget, authority over cadres, personnel, land, resources, assets, administrative procedures, investment decisions, handling of arising issues that have not been regulated, and other contents that can be decentralized and delegated.
The Prime Minister emphasized the requirement that, along with decentralization and delegation of power to localities, central agencies focus on performing state management tasks (developing strategies and plans; institutions and laws; mechanisms and development policies; mobilizing resources; leading and directing implementation; designing inspection and supervision tools; summarizing, rewarding and disciplining).
Giving opinions on specific contents in draft laws and proposing the development of laws to prepare for submission to competent authorities, Prime Minister Pham Minh Chinh stated that the process of building and perfecting institutions and laws needs to be thoroughly grasped, promptly institutionalized, and fully concretized to effectively implement the Party's policies and guidelines.
The dossiers of draft laws and proposals for law making need to clarify the contents of omissions, amendments, improvements, additions, reductions and simplifications of administrative procedures, decentralization and delegation of powers, issues with different opinions and other issues that need to be reported to the Government Standing Committee, the Government, and the Prime Minister for consideration and direction.
The Prime Minister noted that in designing policies and regulations, it is necessary to promote decentralization, delegation of authority and increase the application of technology and digital transformation. At the same time, it is necessary to ensure 6 clarity: "Clear people, clear work, clear time, clear responsibility, clear authority, clear products" in the process of organizing and implementing the law.
