On the morning of September 12th, the Department of Justice organized a dialogue conference on mechanisms for resolving investment-related disputes for businesses in the context of economic recovery and development in Ha Tinh province.

Deputy Director of the Department of Justice Nguyen Quoc Tuan opened the conference.

In his opening remarks, Deputy Director of the Department of Justice Nguyen Quoc Tuan stated: In recent times, the economy has recovered and achieved impressive results. However, along with development come challenges and obstacles, including legal issues. If these issues are not thoroughly resolved, they will lead to disputes, especially investment disputes. This is an extremely complex problem.

Therefore, the conference is an opportunity for agencies, units, and businesses in the area to better understand legal regulations, assess the situation of investment disputes; identify existing shortcomings and limitations, and find effective solutions to minimize the occurrence of disputes.

Nguyen Tien Trinh, Vice Chairman and General Secretary of the Provincial Business Association, addressed the current state of operations and the recovery of businesses after COVID-19.

At the conference, delegates heard about the mechanism for resolving investment disputes under current Vietnamese law; some recommended solutions for businesses to minimize investment disputes; the current state of operations and recovery of businesses after COVID-19; liability for damages due to breach of contract and issues to note; common business disputes and solutions...

In a frank and open manner, the delegates also exchanged views and answered questions related to the mechanism for resolving investment disputes for businesses in the province, as well as some practical situations.

Ms. Tran Thi Tu Anh (Ha Tinh University) proposed adding a regulation requiring parties to continue fulfilling their obligations while a dispute is being resolved.

Some opinions suggest adding regulations that negotiation and mediation should be a mandatory step and must be conducted before the parties bring the dispute to court or arbitration; adding regulations requiring the parties to continue fulfilling their obligations while the dispute is in the process of resolution...

Strengthen monitoring, inspection, supervision, and urging the implementation of projects after the investment policy approval decision and investment registration certificate have been issued. In cases where a project is delayed for an extended period due to reasons on the investor's side, or the investor is unable to continue implementation, procedures and processes for terminating the project must be followed in accordance with regulations... In addition, delegates also proposed several solutions to improve the effectiveness of the law on compensation for damages.

Concluding the conference, Deputy Director of the Department of Justice Nguyen Quoc Tuan requested that local justice departments continue to closely coordinate with the Department of Justice in providing legal support to businesses. Businesses should proactively study legal regulations as well as international treaties on dispute resolution mechanisms; when necessary, they can consult experts, lawyers, and those knowledgeable in the law to minimize legal risks.
