Ho Chi Minh City builds decision on decentralization of construction order management

Vice Chairman of the Ho Chi Minh City People's Committee Bui Xuan Cuong has just signed a document to the Ho Chi Minh City Department of Construction conveying the opinion of the Chairman of the Ho Chi Minh City People's Committee on the construction of a Decision regulating the decentralization of construction order management in Ho Chi Minh City.

Accordingly, the Chairman of the People's Committee of Ho Chi Minh City has approved the proposal of the Department of Construction to register the construction of a decision regulating the decentralization of construction order management in Ho Chi Minh City and apply the simplified procedures in the construction and issuance of the decision. The Chairman of the People's Committee of Ho Chi Minh City has assigned the Department of Construction to be the agency in charge of drafting the Decision regulating the decentralization of construction order management.

According to the draft, the Department of Construction will be responsible for monitoring, inspecting, detecting, preventing and handling construction works for which the Department of Construction has issued construction permits (GPXD) or appraised and approved; construction works approved by ministries and ministerial-level agencies; and granted or approved by specialized departments.

The City High-Tech Park Management Board; Industrial Park Management Board; City Industrial and Export Processing Zone Management Board are responsible for monitoring and inspecting all construction works within the boundaries of industrial parks, export processing zones, and high-tech zones under their management; in case of detecting construction works that violate construction order, they must promptly prevent them and send written information to the Chairman of the People's Committee of the commune, ward, or special zone for handling according to their authority or propose competent authorities to handle violations according to regulations in cases beyond the authority of the Chairman of the People's Committee of the commune, ward, or special zone.

The People's Committees of communes, wards and special zones are responsible for monitoring, inspecting, detecting, preventing and handling construction works without construction permits but, according to regulations, must have construction permits issued by competent state agencies; construction works for which the People's Committees of communes, wards and special zones issue construction permits or appraise and approve according to regulations and according to the decentralization and authorization of the People's Committee of Ho Chi Minh City; construction works and parts of construction works arising after the works have been completed, put into use or have had their certificates of land use rights, house ownership rights and other assets attached to land updated.
