From July 1, 2024, the Law on Identification will take effect, replacing the Law on Citizen Identification. The citizen identification card will have a new name, the ID card. Many new regulations related to the process of issuing and exchanging ID cards will also be officially applied.

More cases of ID card change

The Law on Citizen Identification (currently in effect) stipulates 6 cases in which citizens are granted a replacement citizen identification card.

Specifically, including: when reaching the age to change the card (25, 40 and 60 years old); the card is damaged and cannot be used; there is a change in information about the last name, middle name, first name, and identifying characteristics; re-identification of gender and hometown; there is an error in information on the card; or when the citizen requests.

According to the provisions of the Law on Identification, citizens are allowed to change their ID cards in the following 7 cases: reaching the age to change the card (14, 25, 40 and 60 years old); having changes in information about last name, middle name, birth name, date of birth, month and year of birth; having changes in identity, adding facial photo information, fingerprints, re-identifying gender or changing gender according to the provisions of law.

In addition, there are cases where there are errors in the information printed on the ID card; at the request of the ID card holder when the information on the ID card changes due to administrative unit arrangement; re-establishing the personal identification number; or when the ID card holder requests.

Compared to the Citizen Identification Law, the Identification Law adds many more cases of issuing and exchanging ID cards for citizens. Notably, the case of issuing and exchanging when there are changes due to administrative unit arrangement.

During the law-making process, some delegates proposed to remove this provision from the draft. The reason is that changing ID cards when rearranging administrative units will be costly; while the resolution on rearranging administrative units clearly stipulates that "types of documents issued by competent authorities to individuals, citizens, and organizations before the rearrangement of administrative units, if not expired according to regulations, will continue to be used".

Explaining the above content, the National Assembly Standing Committee said that the provisions in the law help the ID card accurately reflect the citizen's information at the time of card use, ensuring the rights and convenience of the cardholder. In order to avoid causing trouble, the law clearly states that the issuance and replacement of cards will only be carried out when requested by the people.

Shorten the time to issue ID cards

According to current regulations in the Citizen Identification Law, the time limit for issuing citizen identification cards is divided by region.

In cities and towns, no more than 7 working days for new issuance and exchange; no more than 15 working days for re-issuance.

In mountainous, highland, border and island districts, no more than 20 working days for all cases.

In the remaining areas no more than 15 working days for all cases.

From July 1, 2024, when the Law on Identification takes effect, the time limit for issuing identification cards is unified to 7 working days, for all cases of issuance, exchange, and re-issuance.

During the law-making process, some delegates said that with the 7-day deadline as prescribed, it is advisable to decentralize the authority to issue ID cards to localities, instead of the sole focal point being the Ministry of Public Security .

The National Assembly Standing Committee said that with current regulations on centralized database management, checking and comparing citizen identification data needs to be done at the identification data center to ensure accuracy nationwide.

On the other hand, organizing the printing and issuance of ID cards centrally will save costs on purchasing equipment, supplies, raw materials and card printing costs.

Therefore, the Law on Identification only assigns one focal point, the identification management agency of the Ministry of Public Security, with the authority to issue identification cards, which is consistent with current technology and management practices.
