Propagating land law to create consensus

Land complaints currently account for nearly 80% of citizen complaints. From the above reality, it can be seen that in order for people to reach consensus and limit complaints and lawsuits, the process of implementing land recovery and site clearance, propaganda, helping people understand and comply with the law is extremely necessary.

Chau Thanh district leaders met and communicated with households whose land was recovered when implementing projects in the district.

Land acquisition is a sensitive and complicated issue that directly affects land users, especially the lives of people and households. Almost all projects and works when implementing land acquisition and site clearance have difficulties and problems such as: Determining the origin of land, land price, unit price of assets, architectural objects, crops to calculate compensation...

On the other hand, when there is a change in policy and compensation prices, it is easy to compare and complain about the old and new policies, disrupting the progress of project implementation. Meanwhile, the awareness and consciousness of a part of the people in implementing the land acquisition policy and compensation policy is not high, affecting the progress of implementation.

Participating in a dialogue between provincial leaders and people, we can see the important and necessary role of disseminating and propagating legal policies, especially land policies, for people in planning and land acquisition areas.

Specifically, at the dialogue in mid-September, two households in Mai Dam town, Chau Thanh district, did not accept the handover of land for the construction of the Song Hau 2 Thermal Power Plant project. Some households did not agree with the compensation price for their houses, and some requested to be resettled.

Mr. Le Van Ut Muoi, residing in Mai Dam town, stated that his family had a house of nearly 100 square meters that was affected by the project but was only supported with 70% of the house value. Therefore, the family was upset about why some other households in the hamlet were compensated 100% and wanted to be compensated for the house and construction at a higher level. Here, Mr. Nguyen Van Hoa, Vice Chairman of the Provincial People's Committee, directly explained to the households about the rights and obligations of the people when the State reclaims land.

Mr. Hoa said that Mr. Muoi built his house on agricultural land, but at the time of construction, he was not recorded. According to regulations, when building a house in Mai Dam town, people must apply for a construction permit. However, in Mr. Muoi's case, he built his house without permission, so when the land was recovered, the State only supported 70% of the house value, which was in accordance with the law. After listening to the explanation of the provincial People's Committee leaders, the households who had been fiercely complaining gradually agreed.

In recent times, the province has implemented many large projects such as the Can Tho - Hau Giang , Hau Giang - Ca Mau expressways, Song Hau 2 Thermal Power Plant, Vi Thanh City urban upgrading project, Provincial Road 931B, 926B... All of these projects require land acquisition with large areas, affecting many households. However, thanks to good propaganda and mobilization work, most of the people affected by the projects have complied well, many households have proactively handed over the land before the deadline; complaints and denunciations have also been minimized.

Mr. Nguyen Hoang Manh, Vice President of the Lawyers Association, member of the provincial inter-sectoral working group to resolve complaints, shared: Currently, people have little access to information on local planning and land use plans, and if they want to access it, they rarely know which agency to ask. Therefore, this is an area where complaints and denunciations often occur. Therefore, helping people access information, especially information on land, is also a way to limit the number of complaints and denunciations that arise..."

“However, citizens also need to proactively learn about legal regulations, because complying with the law is the right and obligation of citizens. Citizens cannot cite the reason of not being informed or not knowing the regulations, but instead not complying with or violating the law,” Mr. Manh added.

Mr. Nguyen Van On, residing in Phu Xuan hamlet, Chau Thanh district, said: On the people's side, because of life, food and money, they often do not have time to learn about legal regulations, so they do not know clearly what their rights are and what responsibilities they must fulfill to the State.

“In my opinion, when the State provides complete, accurate, and timely information, especially information related to land use planning, transportation, construction, compensation, etc., it will help people understand the problem clearly, limiting the need to file complaints and denunciations,” Mr. On expressed.

To effectively recover land and implement projects, many factors depend on it, of which, propaganda, mobilization, and legal explanation for people in the planning and land recovery affected areas are important and prerequisite factors.

If the above work is done well, it will help projects and works to be implemented on schedule and affected people will also grasp and enjoy their legitimate rights and benefits.
