On May 29th, the Dong Nai Department of Health sent a document to the Food Safety Administration and the People's Committee of Dong Nai province reporting on the progress of inspection, verification, and clarification of information regarding the advertising of the "Nestlé Milo malted milk supplement" product of Nestlé Vietnam Co., Ltd.
Accordingly, on May 21st, the Dong Nai Department of Health submitted a report to the Provincial People's Committee regarding the progress of the inspection, verification, and clarification of information concerning the advertising of the "Nestlé Milo malted milk supplement" product by Nestlé Vietnam Co., Ltd.
On May 28th, the Department of Health, in coordination with relevant departments and agencies, held a meeting to finalize the handling of issues related to food safety inspections at Nestlé Vietnam Co., Ltd.
At this meeting, after reviewing the relevant documents, representatives from the Department of Health and the inspection team agreed: "The case shows signs of deceiving consumers and customers, therefore, we recommend that the Department of Health transfer the case file to the police investigation agency."
On May 29th, the Department of Health sent a document transferring the case file and handing over all relevant documents to the police investigation agency for verification, clarification, and handling of the case in accordance with the law.
As previously reported, following a directive from the Food Safety Department regarding coordinated information handling, the Dong Nai Provincial Department of Health invited relevant parties to a meeting to agree on how to handle information about product advertising.
On May 15th, the Department of Health of Dong Nai province directed the Food Safety and Hygiene Division and the Inspectorate of the Department to coordinate with the Inspectorate and the Press and Publication Management Division (Department of Culture, Sports and Tourism of Dong Nai province) to work with representatives of Nestlé Vietnam Co., Ltd. (An Binh ward, Bien Hoa city).
At the time of the inspection, the company presented two products: "Nestlé Milo 3-in-1 Milk Malt Drink Supplement" (product self-declaration dated December 27, 2021), and "Nestlé Milo Malt Drink Supplement" (product self-declaration dated August 10, 2022), in accordance with a document from the Food Safety Department, which does not involve the use of information from the National Institute of Nutrition as stated on the product labels.
Nestlé Vietnam confirms that it only uses information from the National Institute of Nutrition on the label of the "Nestlé Milo malted milk supplement" product; other products of the company do not use information from the National Institute of Nutrition.
In addition, the company provided a confirmation document from the Institute of Nutrition (dated January 25, 2024) regarding a study evaluating the effectiveness of the product combined with physical education for primary school students, agreeing with the content that: the product helps improve physical fitness qualities after 3 months of use.
While awaiting further instructions, Nestlé Vietnam proactively suspended all advertising related to the National Institute of Nutrition on television, digital platforms, social media, billboards, etc.
At the same time, the company requested its partners to stop posting related content and planned a packaging change, scheduled for launch in September 2025.
On April 22nd, the Food Safety Department of the Ministry of Health sent a letter to the Department of Health of Dong Nai province regarding coordination in handling information related to advertising of Nestlé Milo malted milk product.
Subsequently, on May 23rd, the Chairman of the People's Committee of Dong Nai province issued a document instructing relevant departments and agencies to urgently coordinate with the Provincial Police to investigate Nestlé Milo Co., Ltd.'s advertising of the "malt milk supplement" product.
