The issuance of land use right certificates (LURCs), also known as land ownership certificates, is currently a matter of great concern to most households in Vu Thu district. The issuance of LURCs still faces numerous shortcomings, causing public dissatisfaction. In response to this situation, the People's Committee of Vu Thu district has taken decisive action to resolve these bottlenecks in the LURC issuance process.
The relevant agency is conducting land surveys to carry out procedures for issuing land use right certificates to people in Trung An commune (Vu Thu district).
Resolutely overcome difficulties.
In January 2005, Mr. Nguyen Van Cuong's family, residing in Lang Trung village, Trung An commune, participated in and won the auction for the right to use a plot of land measuring over 80m2 within the village's planned area. He has paid the land use fee as required, but even after 18 years, his family has still not received a land use right certificate for this plot.
Mr. Cuong is not alone; 39 other households in Trung An commune also won the land auction at the same time and paid the land use fees, but have yet to receive their land use right certificates. Over the years, these households have repeatedly gone through the procedures to apply for certificates but have not received them, leading to frustration. Having learned about the issue through a dialogue meeting with the people of Trung An commune at the end of May 2023, in June 2023, the Chairman of the People's Committee of Vu Thu district directly instructed the relevant departments and agencies of the district and the People's Committee of Trung An commune to urgently intervene, coordinate to resolve the obstacles, find solutions, and support Mr. Cuong's family and other households in completing the procedures, determined to complete the issuance of land use right certificates to these 40 households by September 2023.
Not only in Trung An commune, but recently, hotspots and bottlenecks regarding the issuance of land use right certificates in communes and towns have been addressed by Party committees and authorities from the district to the grassroots level. Many difficulties exist in the issuance of land use right certificates in the district, such as incomplete and inconsistent cadastral data; slow updating and adjustment of land use changes; numerous and difficult administrative procedures required for issuing land use right certificates, while coordination between district and local units is not yet close enough. The professional skills and expertise of some grassroots officials, as well as the public's awareness of the requirements and procedures for issuing land use right certificates, are still limited... However, the District People's Committee and the Department of Natural Resources and Environment have issued many documents guiding localities to collect land use fees when issuing land use right certificates for land allocated without proper authority, especially document No. 923/UBND-TNMT, dated July 13, 2022, to rectify administrative procedures in the issuance of land use right certificates. Most recently, the District People's Committee issued Decision No. 4105 on July 14, 2023, establishing a Steering Committee for the pilot issuance of initial land use right certificates at the grassroots level in the district. The district has organized many specialized training courses on the issuance of land use right certificates for leaders, land administration officials, and judicial officials of communes and towns. Listening to and incorporating citizens' opinions, the leaders of the District Party Committee and the District People's Committee recently directed all levels and sectors to take decisive action to resolve a number of long-standing cases related to the issuance of land use right certificates, creating trust and enthusiasm among the people.
Positive numbers
Thanks to the synchronized and decisive involvement of Party committees and authorities from the district to the grassroots level, the issuance of land use right certificates in Vu Thu district has seen many positive changes, clearly evidenced by the continuous increase in the number of certificates issued. While the District People's Committee only issued 355 land use right certificates in 2021, this number increased to 996 in 2022; and in the first six months of 2023, over 400 certificates were issued to households. Notably, the district has successfully resolved several cases of land use right certificate issuance that had been pending for 20 or 30 years in localities such as Tan Phong, Trung An, Song An, Nguyen Xa, Vu Doai, etc., receiving strong recognition and support from the people.
The house and land where Mr. Tran Xuan Cong and Mrs. Tran Thi Dau live in O Me 2 village, Tan Phong commune, have been their home and livelihood for half a century, but they lacked legal documentation. Four years ago, Mr. Cong asked his children and grandchildren to help him apply for a land use right certificate, but despite repeated applications, the certificate was not issued. In March 2023, thanks to comprehensive reforms from the district to the local level, all difficulties were resolved, and the couple finally received their land use right certificate.
"I'm thrilled! My biggest wish before I pass away—to get a land title certificate—has finally come true. Now my wife and I can easily exercise our right to divide and bequeath the land to three of our nine children, preventing potential conflicts between our children and grandchildren regarding the land," Mr. Cong shared.
Continue to engage vigorously.
Mr. Nguyen Tong Thin, Vice Chairman of the People's Committee of Vu Thu District, said: "Receiving land use right certificates is a legitimate and practical need that directly affects the rights and land use plans of the people. The current demand for land use right certificates is very high, and this is also a problem that easily leads to 'hot spots' and public dissatisfaction. With a decisive and determined approach to resolving bottlenecks in the issuance of land use right certificates, Vu Thu District is emphasizing and enhancing the responsibility of officials and civil servants in performing their duties related to receiving, processing, and delivering results of administrative procedures in the land sector. Specialized units and localities are coordinating closely and flexibly in guiding and advising on dossiers, procedures, adjustments, measurements, handling arising issues, and resolving obstacles... in order to reduce inconvenience for citizens and accelerate the progress of issuing land use right certificates." In cases where the eligibility for a land use right certificate is not met, the district requires the relevant specialized units to provide written responses clearly stating the reasons so that citizens can understand the situation and avoid having their applications backlog or delayed.
Officials from Tan Phong commune exchanged information, assessed the situation, and provided guidance and support to the people in completing all procedures promptly and efficiently to expedite the issuance of land use right certificates.
Tan Phong commune has over 3,000 households; however, to date, over 90% of households in the locality have not been granted land use right certificates for their land, houses, and assets on the land. Currently, most households need to apply for land use right certificates. Successfully issuing land use right certificates not only protects the rights of the people but also helps the Party committee and government manage land use effectively, reduce land disputes, and contribute to ensuring security and order at the local level.
“Given the importance of land use right certificate issuance, the commune will thoroughly implement the directives in all villages, coordinating with relevant district units to vigorously carry out the land use right certificate issuance process. Responding to the innovative spirit of the District People's Committee regarding land use right certificate issuance, Tan Phong commune has volunteered to register for a pilot program to simultaneously issue land use right certificates to all households in the near future. While acknowledging this is a difficult and arduous task, we will undertake it with the utmost effort,” added Mr. Nguyen Huu Ngan, Chairman of the Tan Phong Commune People's Committee.
Issuing land use right certificates for the first time is a difficult, sensitive area with many existing problems and obstacles. However, with the active and coordinated efforts of all levels and sectors, Vu Thu district has been creating many positive changes in the issuance of land use right certificates, contributing to better land management, ensuring the legitimate rights and interests of the people, and strengthening the people's trust in the Party committee and the government.
