A series of circulars on land title issuance and land management have been repealed.

DNVN - The Ministry of Natural Resources and Environment has just issued Circular 20/2024/TT-BTNMT on the repeal of a series of legal documents in the field of land. The Circular takes effect from January 1, 2025, notably abolishing many regulations related to the issuance of land use right certificates (red books).

The repealed circulars include Circular 14/2017/TT-BTNMT regulating economic and technical norms in land surveying, cadastral mapping, land registration, and issuance of land use right certificates. In addition, Circular 07/2015/TT-BTNMT is also on the list as it addresses the preparation of land use plans, cadastral surveying, and issuance of certificates for agricultural and forestry companies.

The repeal of numerous circulars and decisions related to land management is seen as an important step towards simplifying administrative procedures.

Furthermore, Circular 30/2013/TT-BTNMT, which stipulated the integration of land surveying, mapping, or updating cadastral maps with land registration, issuance of land use right certificates, and cadastral record building, has also been officially repealed. Following this is Circular 09/2011/TT-BTNMT, a document regulating the bidding process for public service provision related to the issuance of land use right certificates, house ownership certificates, and certificates for other assets attached to land.

Several other documents, such as Circular 09/2006/TT-BTNMT guiding the conversion of land lease contracts when converting state-owned companies into joint-stock companies, are also subject to repeal. Simultaneously, Circulars 20/2022/TT-BTNMT, 11/2021/TT-BTNMT, and 18/2019/TT-BTNMT, along with many other documents related to land resource monitoring, land use planning, and land use status mapping, will also cease to be effective from the beginning of 2025.

Notably, Circular 20/2024/TT-BTNMT also repeals parts of the content of documents such as Circular 24/2019/TT-BTNMT, Circular 11/2022/TT-BTNMT, and Circular 19/2023/TT-BTNMT. This repeal aims to reduce overlapping regulations and facilitate land management.

Following the move by the Ministry of Natural Resources and Environment, the Hanoi People's Committee recently issued Decision 67/2024/QD-UBND, officially abolishing two important decisions related to land use rights auctions in the city. Specifically, Decision 19/2019/QD-UBND and Decision 07/2023/QD-UBND will cease to be effective from December 1, 2024.

According to Decision 19/2019/QD-UBND, the Hanoi People's Committee has the authority to approve the starting price for auctioning land use rights for land allocation or land lease with land use fees. Decision 07/2023/QD-UBND of the Hanoi People's Committee clearly stipulates that prices of 30 billion VND or more will be approved by the city, while other cases will be delegated to the district-level People's Committees. The repeal of these decisions is expected to address existing shortcomings and make the land use rights auction process more transparent and efficient.

The repeal of numerous circulars and decisions related to land management is seen as an important step towards simplifying administrative procedures, creating a transparent legal framework, and improving the efficiency of land management and use in the future.
