Issuing Circular on regulations on doping prevention and control in sports activities

Minister of Culture, Sports and Tourism Nguyen Van Hung has signed and issued Circular No. 01/2024/TT-BVHTTDL regulating doping prevention and control in sports activities.

The Circular consists of 06 chapters and 25 articles regulating doping prevention and control in sports activities (including: Education , communication; Doping testing; Results management; Responsibilities of organizations and individuals in doping prevention and control); Doping prevention and control in sports activities is carried out in accordance with the provisions of the World Anti-Doping Code, international standards of the World Anti-Doping Organization and Vietnam's anti-doping regulations.

Accordingly, the subjects of application of the Circular include: Organizations and individuals participating in sports activities, other organizations and individuals related to sports in Vietnam; Vietnamese organizations and individuals participating in sports activities abroad.

Regarding the principles of doping prevention and control in sports activities , the Circular clearly stipulates: Doping prevention and control activities are organized regularly, ensuring that athletes can practice and compete in a doping-free sports environment; Ensuring compliance with the regulations of the World Anti-Doping Organization, international standards and regulations of Vietnamese law related to doping prevention and control in sports activities; There is close and effective coordination between domestic and foreign sports organizations and individuals in doping prevention and control; Ensuring that athletes are fully educated and informed about doping prevention and control knowledge; Respecting the independence and not interfering in the decisions and professional activities of the Doping Prevention and Control Organization in Vietnam in accordance with the provisions of the World Anti-Doping Code.

Regarding violations of the World Anti-Doping Code , the Circular clearly states: Having a prohibited substance, metabolite or marker of a prohibited substance in an athlete's test sample; Using or intentionally using a prohibited substance or a prohibited method; Avoiding, refusing or missing the sampling without a force majeure reason after notification; Violating requirements related to the presence of athletes for out-of-competition doping testing; Falsifying or obstructing any stage of doping testing; Possessing a prohibited substance or a prohibited method; Trading in a prohibited substance or a prohibited method; Giving an athlete a prohibited substance or a prohibited method during or outside of competition; Supporting, encouraging, assisting, ordering, covering up or being involved in any other complicit act in violating anti-doping regulations;…

Along with that, the Circular also clearly stipulates the authority to conduct doping tests (The Anti-Doping Organization in Vietnam has the right to conduct doping tests on all athletes according to the World Anti-Doping Code; Athlete management agencies and sports tournament organizing committees request the Anti-Doping Organization in Vietnam to conduct doping tests on athletes if necessary according to the World Anti-Doping Code; In cases where international sports federations authorize or request doping tests, the Anti-Doping Organization in Vietnam coordinates with relevant sports federations to conduct doping tests according to the provisions of the World Anti-Doping Code and international standards); Doping test sampling (The anti-doping organization in Vietnam is responsible for planning and organizing the implementation of doping test sampling while ensuring that the sampling, preservation and transportation of samples comply with the provisions of the World Anti-Doping Code and relevant international standards; Doping test sample collectors must be trained and certified according to the provisions of the World Anti-Doping Code and relevant international standards); Notification of doping test sample results (Within 05 working days from the date of doping test results, the anti-doping organization in Vietnam shall notify in writing the test results to the Department of Physical Training and Sports; the agency or organization requesting the doping test, the athlete, and the athlete management unit. For athletes with sample analysis results suspected of doping violations, the notification of results shall be carried out in accordance with the World Anti-Doping Code and relevant international standards).

In addition, the Circular also regulates education and communication to raise awareness of doping prevention and control; Management of doping test results; Responsibilities of organizations and individuals in doping prevention and control.

The Circular takes effect from July 9, 2024.

Circular No. 17/2015/TT-BVHTTDL dated December 30, 2015 of the Minister of Culture, Sports and Tourism regulating doping prevention and control in sports activities; Circular No. 01/2023/TT-BVHTTDL amending and supplementing a number of articles of Circular No. 17/2015/TT-BVHTTDL dated December 30, 2015 of the Minister of Culture, Sports and Tourism regulating doping prevention and control in sports activities cease to be effective from the effective date of this Circular.
