What is the cause?
The reason for the delay in payment and arrears of insurance premiums as stated by Thanh Hoa Provincial Social Insurance is that employers are not strictly aware of the law on social insurance, health insurance, and unemployment insurance. The handling after inspection and examination at enterprises that are late in paying insurance premiums is still limited, and there are no measures to thoroughly handle violations of late insurance premium payment.

Trade unions in some enterprises have not performed well their functions of representing, supervising, and protecting the legitimate rights and interests of workers; a number of workers themselves have inadequate awareness of social insurance, health insurance, and unemployment insurance policies or do not dare to fight.
Only administrative sanctions
Regarding the settlement of the situation of late payment of social insurance, health insurance, and unemployment insurance, Thanh Hoa Provincial Social Insurance said that from 2020 to 2022, through inspection and examination, it has administratively sanctioned 16 units for late payment of social insurance, health insurance, and unemployment insurance with a fine amount of 1,935.98 million VND.

However, up to now, in Thanh Hoa province, no grassroots trade union has sued enterprises that owe or delay in paying social insurance for a long time. The reason is that the majority of grassroots trade unions are part-time and receive salaries from enterprises, so it is very difficult to sue enterprises.
Strictly handle the responsibility of heads of administrative units that cause late payment of social insurance.
Regarding the field of social insurance, previously, on April 13, at the direct and online explanation session on the prolonged delay in paying social insurance, health insurance, and unemployment insurance in the province, Thanh Hoa Provincial Party Secretary Do Trong Hung clearly stated that the responsibility of heads of administrative units that caused the delay in paying social insurance must be strictly handled.
Incorporate the criteria of correct, full and timely payment of social insurance into the criteria for evaluating the performance of the unit's political tasks every year. In case the unit or enterprise owes, avoids payment, or fails to fully fulfill the obligation to pay social insurance for employees, the emulation titles will not be considered.
At the same time, the Secretary of the Thanh Hoa Provincial Party Committee also requested the Public Security Department to proactively coordinate closely with the Social Insurance Department to prevent, detect, combat and combat crimes and violations of the law in the field of Social Insurance. The Department of Labor, War Invalids and Social Affairs shall strengthen inspection, examination and strictly handle enterprises violating the law on Social Insurance.
The Department of Health shall promote propaganda, dissemination, guidance on implementation and coordinate with the Social Insurance agency to inspect and handle violations in the implementation of policies and laws on health insurance.
Thanh Hoa Provincial Tax Department directs its affiliated units to coordinate with the Social Insurance agency to urge units to pay social insurance according to regulations when conducting tax inspections and audits. The Provincial Labor Federation promotes propaganda and dissemination of social insurance laws, policies and regimes with appropriate forms and contents to raise awareness, create consensus, and voluntary compliance with social insurance laws of employers, union members, and employees.
