Ministry of Information and Communications issues Circular guiding Decree on IT investment from state budget

The Circular details the implementation, supervision, and acceptance of information technology application investment projects; determines service quality requirements and specific contents of service rental contracts for information technology service rentals according to specific requirements.

On December 30, 2024, the Minister of Information and Communications issued Circular No. 16/2024/TT-BTTTT detailing the contents of implementation, supervision of implementation, and acceptance of information technology application investment projects; determining requirements on service quality and specific contents of service rental contracts for information technology service rental according to specific requirements). The Circular takes effect from February 14, 2025.

Accordingly, this Circular details the contents assigned by the Government in Decree No. 73/2019/ND-CP dated September 5, 2019 of the Government regulating the management of investment in information technology application using state budget capital (amended and supplemented by Decree No. 82/2024/ND-CP dated July 10, 2024 of the Government), including:

- Contents of implementation, supervision of implementation, acceptance of information technology application investment projects are specified in Clause 5, Article 32 of Decree No. 73/2019/ND-CP (amended and supplemented in Clause 23, Article 1 of Decree No. 82/2024/ND-CP).

- Determine the requirements for information technology service quality according to specific requirements specified in Clause 3, Article 54 of Decree No. 73/2019/ND-CP (supplemented at Point b, Clause 32, Article 1 of Decree No. 82/2024/ND-CP).

- Specific contents of the contract for leasing information technology services according to specific requirements specified in Clause 5, Article 52 of Decree No. 73/2019/ND-CP (amended and supplemented in Clause 30, Article 1 of Decree No. 82/2024/ND-CP).

Contents of this Circular:

(1) Merge the contents of the two previous Circulars, namely Circular No. 23/2020/TT-BTTTT dated September 9, 2020 of the Minister of Information and Communications stipulating the specific contents of contracts for leasing information technology services using state budget funds and Circular No. 24/2020/TT-BTTTT dated September 9, 2020 of the Minister of Information and Communications stipulating the implementation, supervision of the implementation and acceptance of information technology application investment projects.

(2) Supplement regulations on implementation, implementation supervision, and trial operation organization for popular software; Supplement regulations on determining information technology service quality requirements according to specific requirements.

Circular regulating the establishment and management of investment costs for information technology application and hiring of information technology services using state budget capital.

On December 30, 2024, the Minister of Information and Communications issued Circular No. 18/2024/TT-BTTTT regulating the establishment and management of investment costs for information technology applications and hiring information technology services using state budget funds. The Circular takes effect from February 14, 2025.

Accordingly, this Circular details the contents assigned by the Government in Decree No. 73/2019/ND-CP dated September 5, 2019 of the Government regulating the management of investment in information technology application using state budget capital (amended and supplemented by Decree No. 82/2024/ND-CP dated July 10, 2024 of the Government), including:

- Method for determining the preliminary total investment level specified in Clause 2, Article 12 of Decree No. 73/2019/ND-CP (amended and supplemented in Clause 10, Article 1 of Decree No. 82/2024/ND-CP).

- Method for determining total investment level specified in Point d, Clause 4, Article 19, Decree No. 73/2019/ND-CP (amended and supplemented at Point d, Clause 13, Article 1, Decree No. 82/2024/ND-CP).

- Methods for determining estimates, establishing norms, unit prices for each period and managing costs are specified in Point a, Clause 2, Clause 3, Article 28 of Decree No. 73/2019/ND-CP (amended and supplemented in Clause 20, Article 1 of Decree No. 82/2024/ND-CP).

- Contents and methods for determining administration, operation and maintenance costs are specified in Clause 4, Article 40 of Decree No. 73/2019/ND-CP (amended and supplemented in Clause 26, Article 1 of Decree No. 82/2024/ND-CP).

- Method for determining service rental costs according to specific requirements specified in Point c, Clause 2, Article 55, Decree No. 73/2019/ND-CP (amended and supplemented at Point b, Clause 33, Article 1, Decree No. 82/2024/ND-CP).

Contents of this Circular:

(1) Merge the contents of 02 previous Circulars, namely Circular No. 04/2020/TT-BTTTT dated February 24, 2020 of the Minister of Information and Communications regulating the establishment and management of costs of information technology application investment projects and Circular No. 12/2020/TT-BTTTT dated May 29, 2020 of the Minister of Information and Communications guiding the determination of costs of renting information technology services using state budget funds according to the cost calculation method.

(2) Supplementing instructions on methods for determining the preliminary total investment; Supplementing methods for determining the costs of administration, operation and maintenance of products of IT application investment projects; Supplementing instructions on methods for determining the costs of renting IT services; Removing the regulation on determining the costs of renting information technology services according to the payment method at the beginning of the period; Amending the regulations on methods for making estimates for IT application investment and renting IT services according to quotations.

With the issuance of these two Circulars, the legal framework for IT application investment and IT service rental using state budget funds has been basically complete, creating favorable conditions for ministries, branches, localities, agencies and units to promote digital transformation in the coming period./.
