The Ministry of Health said that the Law on Prevention and Control of Infectious Diseases No. 03/2007/QH12 was passed by the 12th National Assembly, 2nd session on November 21, 2007, effective from July 1, 2008. In more than 17 years of implementation, many positive results have been achieved in the work of protecting, caring for and improving people's health. However, there are still shortcomings in quality of life, disease burden, causes related to nutrition and environmental factors as well as gaps in policies regulating non-communicable disease prevention and mental health.
The development of a new Law with a comprehensive scope of regulation covering all disease prevention activities is extremely necessary to overcome shortcomings and inadequacies in the work of protecting, caring for and improving people's health to meet practical requirements in the new situation.
In recent times, besides the positive results achieved in the work of protecting, caring for and improving people's health, the implementation still has shortcomings and inadequacies: people's quality of life is still limited due to illness; Vietnamese people have a relatively high life expectancy compared to countries with the same standard of living, but have more years living with illness.
The reasons are: an unreasonable diet leading to limited physical development and stature of Vietnamese people as well as an increase in non-communicable diseases related to nutrition; the rapid increase in non-communicable diseases and disease burden; the increase in environmental risk factors such as environmental pollution, limited awareness of personal hygiene and environmental hygiene among people, climate change and extreme weather events... affecting the health of many communities, contributing to an increase in hospitalizations.
Solving problems from policy mechanisms and legal gaps in disease prevention activities. Through reviewing the Vietnamese legal system, it can be seen that although there are up to 63 legal documents regulating activities related to disease prevention and health promotion, in reality, the current legal system mainly focuses on 3 main issues: (1) Disease treatment; (2) Prevention and control of infectious diseases; (3) Management of some behaviors harmful to health (alcohol, tobacco, environmental destruction, domestic violence, etc.) but there are absolutely no regulations to regulate issues related to nutrition and health, mental health, management of non-communicable diseases, and disease prevention funds.
According to the Ministry of Health, in order to overcome the above shortcomings and inadequacies as well as institutionalize the policies and orientations of the Party, the tasks assigned by the National Assembly , the Government, and the Prime Minister, the development of a new law with a scope of regulation including activities on prevention and control of infectious diseases; prevention and control of non-communicable diseases; prevention and control of mental health disorders; ensuring nutrition in disease prevention; disease prevention against the impact of other risk factors; conditions to ensure disease prevention to address legal gaps, activities related to prevention and health promotion while replacing the Law on Prevention and Control of Infectious Diseases is completely appropriate, does not cause overlap in the legal system and is extremely necessary in the current period.
Scope of regulation, applicable subjects
The draft Law on Disease Prevention proposes regulations on information, education, and communication on disease prevention; prevention and control of infectious diseases; prevention and control of non-communicable diseases, mental health disorders and other risk factors; nutrition in disease prevention and conditions to ensure disease prevention.
The Draft Law on Disease Prevention applies to domestic and foreign agencies, organizations and individuals in Vietnam.
Outline of the draft Law on Disease Prevention
The Ministry of Health proposed a draft Law on Disease Prevention consisting of 06 Chapters with 46 articles:
- Chapter 1: General provisions, including Articles 1 to 13;
- Chapter 2: Prevention and control of infectious diseases, including Articles 14 to 24;
- Chapter 3: Prevention and control of non-communicable diseases, mental health disorders and other risk factors, including Articles 25 to 31;
- Chapter 4: Nutrition in disease prevention, including articles from Article 32 to Article 35;
- Chapter 5: Conditions to ensure disease prevention, including Articles 36 to 43;
- Chapter 6: Implementation provisions, including Articles 44 to 46.
According to the draft, the following acts are strictly prohibited in disease prevention activities: 1. Intentionally spreading infectious agents. 2. People with infectious diseases, people suspected of having infectious diseases and people carrying infectious pathogens who perform acts that easily transmit infectious agents as prescribed by law. 3. Concealing, failing to declare or failing to promptly declare cases of infectious diseases as prescribed by law. 4. Intentionally declaring or providing false information about infectious diseases. 5. Discrimination, stigmatization and negative images and information about people with infectious diseases. 6. Failure to implement or failure to promptly implement measures to prevent and control infectious diseases as prescribed by this Law. 7. Failure to comply with measures to prevent and control infectious diseases as required by competent authorities and organizations. 8. Intentionally polluting water sources used by people in daily life. 9. Organizing vaccination at unqualified vaccination facilities. 10. Unauthorized access, theft, misuse or change of use without approval from competent authority or intentional release of biological agents. 11. Using superstitious practices in disease prevention. |
