Criteria for selecting suppliers of railway industrial goods and services.

The Government has issued Decree No. 4/2026/ND-CP dated January 10, 2026, regulating the assignment of tasks, orders, and selection criteria for Vietnamese organizations and enterprises assigned tasks and orders to provide railway industrial goods and services.

This Decree regulates the assignment of tasks, orders, and selection criteria for Vietnamese organizations and enterprises assigned to provide railway industrial goods and services under railway procurement and construction investment programs and projects using state budget funds, excluding state budget funds from recurrent expenditure sources.

Supplier selection criteria

The decree stipulates that railway industrial goods and services providers must simultaneously meet the following eight criteria:

1. Having functions and responsibilities within the organization or registered business lines and operating licenses for enterprises that are consistent with the assigned tasks and orders.

2. Not currently undergoing dissolution procedures or having its business registration certificate revoked; not subject to insolvency as defined by bankruptcy law.

3. Regarding financial capacity:

a) The supplier's net asset value in the most recent fiscal year must not be negative; they must have sufficient capacity in terms of securing equity capital, debt financing, and other legal sources of funding to fulfill assigned tasks and orders;

b) Having an average annual revenue of at least VND 8,000 billion for the three most recent fiscal years for businesses established for three years or more, or a minimum charter capital of VND 3,000 billion for businesses established for less than three years;

c) For suppliers with foreign investment, it must be ensured that at least one domestic investor owns more than 35% of the charter capital.

4. Regarding infrastructure: sufficient capacity in terms of workshops, warehouses, yards, machinery, equipment, and technological lines to serve production and testing, ensuring that the requirements of assigned tasks and orders are met. Priority should be given to selecting suppliers with modern training facilities, research and development facilities for railway industrial goods and services, suitable for the assigned tasks or orders.

5. Regarding human resources: We have a sufficient team of personnel, experts, technical staff, and workers with management and research capabilities, professional qualifications, and skills to ensure that we meet the requirements of the assigned tasks and orders.

6. Regarding competence and experience in performing the task:

a) Possessing advanced technical solutions, production processes, and technologies that are customizable and adaptable; having a commitment and specific plan to implement product localization, ensuring a gradual increase in the localization rate over time, in accordance with the roadmap announced by the Ministry of Industry and Trade ;

b) Having completed at least one task or project in a similar field or demonstrating operational experience in a similar field or industry providing similar services or goods, or having a cooperation agreement with a partner experienced in providing the assigned or ordered railway industrial services or goods. In the case of a foreign organization or enterprise, there must be a commitment to transfer all or part of the technology to the supplier in accordance with the law on technology transfer;

c) Possess the capacity and plan to receive technology transfer to fulfill assigned tasks and orders for the provision of railway industrial goods and services;

d) There is a commitment to ensuring the timely completion of the task; there is a plan to mobilize resources to meet the requirements of the assigned task or order;
