The Vietnam Federation of Commerce and Industry (VCCI) has just organized a consultation on the Law amending and supplementing a number of articles of the Law on Pharmacy.
One of the notable points of the draft is the regulation that retail establishments are allowed to sell drugs on the list prescribed by the Ministry of Health that are allowed to be sold via e-commerce and in accordance with the scope of business.
Clause e, point 2, Article 42 of the draft stipulates: Establishments that have been granted a certificate of eligibility for pharmaceutical business are allowed to conduct pharmaceutical business through e-commerce through: Website, sales application installed on the establishment's electronic devices; electronic trading floors licensed by the industry and trade sector (not allowed to be conducted on social networking platforms, online livestream).
Specifically, drug manufacturing, import-export and wholesale establishments are allowed to sell drugs via e-commerce for drugs within their scope of business; retail establishments are allowed to sell drugs on the list prescribed by the Ministry of Health that are allowed to be sold via e-commerce and in accordance with their scope of business;
Post product information without having to seek confirmation from the regulatory agency, including: drug packaging, drug instructions in accordance with the information content on the drug instructions, and approved drug labels.

But in principle, wholesale companies (achieving GDP) are not allowed to retail to people. This issue needs to be clarified when businesses have retail chains selling drugs to people, because it is related to the responsibility of each entity when handling the case.
Besides, counterfeit goods sold on the internet are a new front because 80% - 90% of counterfeit goods are bought and sold online. Therefore, the authorities are facing a lot of difficulties because handling them in real life is difficult, detecting and handling violations in cyberspace is even more difficult..." - Mr. Nguyen The Tin said.
Therefore, the representative of the Vietnam Pharmaceutical Association suggested that the Drafting Committee should consider clearer and stricter regulations on this new business method.
