Tensions are rising in the inheritance dispute of the late Meritorious Artist Vu Linh.

Báo Thanh niênBáo Thanh niên07/01/2025

On January 7th, the Ho Chi Minh City People's Court opened the first-instance trial of a dispute over inheritance; a request to annul a specific decision and to reclaim a house used for temporary residence related to the inheritance of Mr. Vo Van Ngoan (the late artist Vu Linh), between the plaintiff, Ms. Vo Thi Hong Nhung (younger sister of Meritorious Artist Vu Linh), and the defendant, Ms. Vo Thi Hong Loan (daughter of Meritorious Artist Vu Linh).

Ms. Hong Nhung presented her lawsuit demands, including: requesting the court to annul the birth certificate and the adoption agreement between Mr. Vo Van Ngoan and Ms. Hong Loan; determining that Mr. Ngoan has no first-degree heirs; and demanding that the defendant vacate the house at 5 Doan Thi Diem Street (Phu Nhuan District, Ho Chi Minh City) and hand over the house and car documents to the plaintiff.

Hong Loan's side presented a counterclaim, rejecting all of the plaintiff's claims. The defendant is a first-degree heir and has submitted all the necessary documents to the court verifying her legal status as the child of Meritorious Artist Vu Linh. Ms. Loan filed a counterclaim, requesting that Ms. Nhung and Ms. Le Thi Hong Phuong remove all their belongings from house number 5 Doan Thi Diem.

Hong Loan asserts she is the legitimate child.

During the questioning, the lawyer representing Ms. Hong Nhung asked Ms. Hong Loan about her cohabitation with Meritorious Artist Vu Linh, as well as whether Ms. Loan was his biological or adopted daughter. In response, Ms. Loan stated: "I am my father's daughter. My birth certificate doesn't state whether I am adopted or biological. My father never said I was adopted."

Ms. Hong Loan further stated that when she was 3 months old, Mr. Tran Quoc Thanh took her to her grandmother's house (the mother of Meritorious Artist Vu Linh) to raise her. Because Meritorious Artist Vu Linh was often away performing, Ms. Loan was cared for by Mr. Thanh and a housekeeper. Throughout their time together, there were no conflicts between her and Meritorious Artist Vu Linh. At the age of 17, Ms. Loan got married and moved to her husband's house, occasionally visiting Meritorious Artist Vu Linh.

In this dispute, Hong Loan is the defendant.

Regarding the funeral arrangements for Meritorious Artist Vu Linh, Ms. Loan stated that when Vu Linh fell ill and subsequently passed away in March 2023, she and her family meticulously organized and handled the funeral. However, due to overwhelming grief at the time, she couldn't recall the exact amount she contributed to the funeral. Regarding the construction of the tomb, Ms. Loan stated she was unaware of the details as she had no involvement.

When asked why she had to declare her inheritance, Ms. Loan explained that it arose after the death of Meritorious Artist Vu Linh, when Hong Phuong went to the media and claimed that Ms. Loan was her adopted daughter. Furthermore, during a family meeting, Ms. Nhung and Ms. Phuong requested to be listed as co-owners of Meritorious Artist Vu Linh's house.

Ms. Hong Nhung claims that the birth certificate is illegal.

Next, the lawyer questioned Ms. Hong Nhung about the process of adopting Ms. Hong Loan. Ms. Nhung explained that in 1987, Mr. Thanh brought Ms. Loan home to raise her. After Ms. Nhung's mother passed away, she and other family members took care of Hong Loan.

Regarding the adoption papers and birth certificate showing that Meritorious Artist Vu Linh acknowledged Hong Loan as his daughter, Ms. Nhung asserted: "My brother never processed any paperwork for Ms. Hong Loan. At the time of processing the paperwork, which was on a Saturday or Sunday… my brother was an artist, performing two shows on weekends, so he was very busy and couldn't go to process the paperwork. Ms. Loan's birth certificate and adoption papers are illegal, therefore she has no first-degree heirs."

Ms. Hong Nhung answers questions from the lawyer at the trial.

At the same time, Ms. Nhung added that Meritorious Artist Vu Linh had once told her about how Ms. Loan had caused him sorrow. Ms. Nhung felt very sorry for them and had repeatedly tried to mend the relationship between Meritorious Artist Vu Linh and Ms. Loan.

Regarding the reason for filing the lawsuit and requesting inheritance division immediately after the death of Meritorious Artist Vu Linh, Ms. Nhung stated that her family had sheltered Ms. Loan for many years, but Ms. Loan's behavior was very cruel, driving her family out of their home, so she had to seek legal protection.

At the trial, Ms. Le Thi Hong Phuong stated that she did not request a share of the inheritance of the house at 5 Doan Thi Diem Street because, during his lifetime, Meritorious Artist Vu Linh had told her about this house and asked her to live there.

Hong Phuong also argued that birth certificates and adoption papers were illegal.

"In 2017, my uncle fell ill and repeatedly told many people to give me this house. In 2021, my uncle asked me to record a video of the house for him, and I had it notarized. After my uncle passed away, my family held a meeting to discuss living together in the house, but on April 27, 2024, Ms. Loan presented a document transferring ownership of the house and demanded that my mother and I leave," Hong Phuong explained.

Ms. Phuong also stated that the birth certificates and adoption documents are illegal. Regarding the media's statement that Meritorious Artist Vu Linh has no biological children, Ms. Phuong said that because Ms. Loan had told the press that she was his biological daughter, she had to issue a correction to avoid damaging Meritorious Artist Vu Linh's reputation.

The court is continuing the arguments.
