Decree No. 151/2025/ND-CP also removes 3/8 of the documents of administrative procedures.
The Decree also stipulates that when issuing certificates, commune-level People's Committees do not need to require people to submit confirmation of non-dispute status, planning compliance and stability in land use; and maintain the validity of contracts signed before July 1, 2025 until the expiration of the contract term.
Regarding the order and procedures for land registration and property attached to land, the representative of the Department of Land Management said that according to Decision 2304/QD-BNNMT promulgating administrative procedures in the land sector under the state management function of the Ministry of Agriculture and Environment , the total number of land administrative procedures is 48, including 27 procedures for registration, granting of certificates, and ownership of property attached to land (21 procedures at the provincial level, 6 procedures at the commune level).
Previously, at the National Training Conference on decentralization, delegation of authority, and determination of authority in the land sector, which was connected online to more than 3,400 points of connection nationwide, held on the morning of August 1, Deputy Minister of Agriculture and Environment Le Minh Ngan affirmed that land is the main means of production, closely linked to most socio -economic, defense - security and environmental activities. Therefore, strong innovation of institutions, apparatus, processes and responsibilities in land management is always a top priority.
Mr. Ngan also said that from the 2003 Land Law to 2013, the content of decentralization to local authorities was gradually improved. In particular, the 2024 Land Law marked a breakthrough when it strongly expanded decentralization and delegation of power to two levels of government: province and district.
Except for some specific contents such as planning and land use plans, which are still implemented by the Central Government, activities such as land allocation, land lease, change of land use purpose, recovery, compensation, support, resettlement, land valuation, and issuance of land use right certificates are all transferred to localities.
According to Mr. Ngan, decentralization is not simply transferring power from the central government to the local government, but also changing the mindset, promoting initiative and accountability. Clearly defining the authority between the central government and local government, provinces and communes will reduce overlap, shorten the time to process administrative procedures, and improve the quality of service for people and businesses.
However, in practice, decentralization still faces many difficulties, especially at the grassroots level, where records are directly handled; many places lack specialized staff, lack supporting information technology systems, and are still afraid of responsibility when receiving new authority.
Therefore, this conference was held to fully and uniformly convey the contents related to decentralization, delegation of power, and determination of authority in the land sector to cadres from the central to communal levels./.
