Legal aid is a humane policy of the State aimed at ensuring access to justice for the poor, ethnic minorities, children, and vulnerable groups in society.

Over the years, legal aid activities in Quang Ninh have become increasingly substantive, with a continuous increase in the number of cases involved in litigation, improved service quality, and a wider scope of access. In the context of the 2026 amended Law on Legal Aid, the provincial Department of Justice is also proactively preparing the necessary conditions to effectively implement the new regulations at the grassroots level.

Improving the quality of legal aid

In recent years, legal aid services in the province have seen many positive changes, especially in the quality and effectiveness of cases involving litigation. During the period 2018-2025, the province handled 1,737 legal aid cases for 1,737 eligible individuals. This included 1,314 litigation cases, 403 legal consultation cases, and 20 cases of representation outside of litigation. The criminal sector alone accounted for 1,156 cases, demonstrating the continued high demand for protecting the legal rights and interests of vulnerable groups in litigation.

While in the past, legal aid activities mainly focused on legal consultation, since the Law on Legal Aid of 2017 came into effect, the number of cases involved in litigation has increased significantly. On average, during the period 2015-2017, the entire province handled approximately 104 cases involved in litigation each year; this is expected to increase to about 164 cases per year during the period 2018-2025.

In 2025, the Provincial State Legal Aid Center handled 197 cases for 197 individuals; of which 192 cases involved litigation, accounting for over 97% of the total number of cases. Notably, 144 cases were assessed as successful and effective according to the criteria of the Ministry of Justice .

The effectiveness continued into 2026. From January 1st to May 31st, 2026 alone, the Provincial State Legal Aid Center handled 132 cases for 132 individuals, of which 130 involved litigation. Compared to the same period in 2025, the total number of cases increased by 62.9%, while the number of cases involving litigation increased by 62.5%.

Mr. Hua Quang Viet, Acting Director of the Provincial State Legal Aid Center,   The center stated: "We always consider the quality of cases to be a key factor. Each legal aid case is not just about carrying out a professional procedure, but also about protecting the legal rights and interests of the person receiving legal aid, contributing to strengthening people's trust in the law."

Besides handling specific cases, communication efforts to bring legal aid policies closer to the people have also been emphasized. In 2025, the Center organized 58 legal aid conferences at the grassroots level with 3,402 participants; distributed 26,000 legal leaflets and 6,500 pocket-sized documents on legal aid and related legal fields. For ethnic minority, mountainous, border, and island areas, the Center handled 45 legal aid cases for ethnic minorities; and distributed nearly 39,720 free leaflets and 11,100 legal documents to help people access legal information more easily.

Proactively prepare for new regulations.

After nearly nine years of implementing the 2017 Legal Aid Law, legal aid activities in Quang Ninh province have seen many positive changes, creating an important foundation to ensure access to justice for the people, especially the poor, children, ethnic minorities, and policy beneficiaries. However, practical implementation has also revealed that some regulations are no longer suitable, especially for complex, protracted cases or those with new requirements arising in legal aid activities.

On June 26, 2026, the National Assembly passed Law No. 05/2026/QH16 amending and supplementing a number of articles of the Law on Legal Aid, effective from January 1, 2027. The new law is expected to further improve the legal framework, enhance the quality of legal aid services, and better meet the needs of the people in the new period.

To prepare for the implementation of the new regulations, the Department of Justice organized a review of the implementation of Decree No. 144/2017/ND-CP, and simultaneously conducted a comprehensive review of legal aid activities in the province. Through this review, the locality proposed adjustments to some regulations related to limiting the number of legal aid sessions for complex and protracted cases; and also proposed a more appropriate mechanism to ensure the well-being of legal aid providers, contributing to improving the quality and effectiveness of legal aid activities in the future.

The restructuring of the organizational apparatus and the digital transformation in legal aid activities are being accelerated. Legal aid cases are updated on the Legal Aid System; statistical work is carried out using specialized software. The Center is also equipped with a room for participating in online court hearings to support professional activities.

Mr. Nguyen Chinh Nghia, Deputy Director of the Department of Justice, said: The Department of Justice is proactively reviewing relevant regulations, preparing human resources, infrastructure, and strengthening coordination with prosecuting agencies to ensure that the new regulations are implemented synchronously and effectively when the law comes into effect.

As early as January 2026, the Provincial People's Committee issued a plan for implementing legal aid services in the province; simultaneously, in April 2026, the Provincial People's Council issued Resolution No. 03/2026/NQ-HĐND stipulating the legal aid policy for ethnic minorities in communes, wards, special zones, villages, hamlets, and neighborhoods in ethnic minority, mountainous, border, and island areas for the period 2026-2030. This is considered an important foundation for expanding access to legal aid for the groups most in need of support.

With the results achieved, legal aid work in Quang Ninh continues to affirm its role as an important legal welfare policy, contributing to protecting the legitimate rights and interests of the people, while improving access to justice and ensuring law enforcement at the grassroots level.
