Member of the Central Committee of the Party, Vice Chairman of the National Assembly Le Minh Hoan - Head of the supervisory delegation, chaired the working session.

During the meeting, members of the delegation asked several questions requesting the Ministry of Justice to clarify various aspects of improving policies and laws on environmental protection; the organization of implementation; and the results of reviewing the legal system on environmental protection.
Reporting to the supervisory delegation, Deputy Minister of Justice Nguyen Thanh Tu stated that the 2020 Environmental Protection Law has tasked the Government, the Prime Minister, and ministries and ministerial-level agencies with developing and promulgating nine detailed regulations. These documents have been fully issued. The Ministry of Justice's work in providing feedback and conducting assessments on projects and draft legal documents in the field of environmental protection has ensured timely progress and met quality requirements.
In general, the system of legal documents on environmental protection is fundamentally comprehensive, holistic, and harmonized with the legal system on socio-economic issues. Decrees and guiding circulars are developed according to proper procedures; ensuring timeliness, completeness, and specificity, serving as a basis for implementing and managing environmental protection work.
However, there are still 24 issues related to the Environmental Protection Law that present difficulties and obstacles. Some documents have not been issued in a timely manner or have only been issued in 2025. Notably, these are important documents aimed at promoting the green energy and green finance transition roadmap in Vietnam; creating a complete legal basis for the formation and operation of the domestic carbon market; and are also new and challenging issues.
For example, the draft Decree on the domestic carbon exchange has been reviewed by the Ministry of Justice, but has not yet been promulgated. Decision No. 21/2025/QD-TTg of the Prime Minister, which promulgates environmental criteria and the confirmation of projects eligible for green credit and green bonds, was recently issued and will take effect from August 22, 2025. The Ministry of Justice has requested the Ministry of Agriculture and Environment to study these obstacles and make as many amendments as possible during the process of drafting one law amending 15 laws, which will be submitted to the National Assembly in the near future.
In addition, 31 out of 33 problematic issues in Decree 08/2022/ND-CP detailing some provisions of the Law on Environmental Protection have been amended in Decree 05/2025/ND-CP; the remaining 2 problematic issues are currently being amended by the Ministry of Agriculture and Environment.
In his directive speech, Vice Chairman of the National Assembly Le Minh Hoan requested the Ministry of Justice to proactively research and propose amendments and additions to the Law on Environmental Protection and other laws, ensuring that lawmaking is linked to practical requirements and that proposals and recommendations are effective and highly feasible.
Furthermore, the Ministry of Justice needs to innovate its thinking and orientation in lawmaking; closely linking lawmaking and law enforcement. This will contribute to promptly resolving new bottlenecks that may arise and be in line with the new context of two-tiered local government.
"This is an extremely important issue, determining the effectiveness and efficiency of state management and the organization of law enforcement regarding environmental protection," the Vice Chairman of the National Assembly emphasized.
