The issues surrounding land for new residential construction will be resolved.

Accordingly, the Ho Chi Minh City Inspectorate has sent a document to departments and localities requesting reports on the situation regarding complaints and grievances from citizens related to areas planned for new residential construction. These complaints cover the period from January 1, 2018, to May 31, 2023. Reports must be submitted to the Ho Chi Minh City Inspectorate no later than June 9th.

Earlier, Vice Chairman of the Ho Chi Minh City People's Committee Bui Xuan Cuong held a meeting with relevant departments and agencies regarding complaints and grievances from residents about land for new residential construction.

Regarding this issue, Thanh Nien Newspaper has published numerous articles reflecting the frustrations of people whose land and houses within newly planned residential areas are being denied land use conversion, subdivision, and construction permits.

The city has over 14,000 hectares of land designated for mixed-use development and new residential construction.

Notably, the term "newly built residential land" is not found in any legal documents, such as the Land Law or the Housing Law. Instead, Ho Chi Minh City itself coined this term, along with the term "mixed-use land," causing hardship for residents since the beginning of 2018 when Decision 60, issued by the People's Committee of Ho Chi Minh City, which stipulates the minimum area for land subdivision, came into effect.

Preliminary statistics in Binh Chanh district show that nearly 15,000 hectares of land are planned for new residential construction, affecting nearly 13,500 households. In Binh Tan district, according to statistics from 1/2000 scale zoning plans, there are a total of 155 land areas currently being planned with two functions: new residential construction and mixed-use, covering more than 341 hectares. The People's Committee of Binh Tan district acknowledges that addressing the needs of residents in these two planning functions is currently very limited, affecting their legitimate land rights and interests.

A recent report from the Department of Planning and Architecture shows that the entire city has more than 14,000 hectares of land designated for mixed-use and new residential construction. Given the scale of these two land types, it is possible that thousands of individuals and households have been unable to complete the land subdivision procedures as needed in the past.

Regarding Decision 60, although it remains in effect, it is hardly being applied by any locality in Ho Chi Minh City. The Ho Chi Minh City Department of Natural Resources and Environment stated a long time ago that it had submitted a draft amendment to Decision 60 to the Ho Chi Minh City People's Committee, but to date, this decision has not been implemented, leaving the rights of citizens still "pending".

Many people expect that this time, the Ho Chi Minh City People's Committee will resolve the obstacles for residents building new houses and mixed-use land, thereby restoring the rights of the people.
