Prime Minister Pham Minh Chinh has just signed and promulgated Directive No. 18/CT-TTg dated May 30, 5 on promoting connection and data sharing for e-commerce development, combating tax loss, and ensuring monetary security.

The directive states that, in recent years, Vietnam's digital economy has had a strong development, with the important contribution of e-commerce. In order to improve the efficiency of state management of e-commerce activities, business on digital platforms, tax management, the Government and the Prime Minister have issued many policies, regulations and drastic measures in direction and administration.
On that basis, the Ministry of Finance and related ministries and agencies have organized and implemented solutions to reform, cut administrative procedures, modernize and apply information technology in the fields of taxation, e-commerce, etc., contributing to support and promote the widespread application of e-commerce in businesses and the community, building a healthy, competitive and sustainable e-commerce market.
However, in the context of the rapidly developing and booming e-commerce market, it has posed significant challenges in the management of e-commerce business activities, tax management, ensuring the principle of fairness, risk management based on a large database platform, etc. to adapt to the change of the business environment on the digital platform; In particular, it is necessary to have close coordination between specialized state management agencies to fully manage participants, control payment transactions, and authenticate information of business organizations and individuals and taxpayers. Compliance with these principles also contributes to ensuring an equal and friendly business environment, jointly developing and promoting the great values that the e-commerce field brings to individuals, businesses and the Vietnamese economy, making a commensurate contribution to the state budget.
In order to increase the effectiveness, efficiency and continue promoting digital transformation in state management of e-commerce activities, business activities on digital platforms, cross-border business, connecting and sharing data among ministries and sectors in service of e-commerce development, combating tax loss, ensuring monetary security, Prime Minister Pham Minh Chinh requested the Ministry of Finance to assume the prime responsibility for, and coordinate with other ministries and sectors in, amending policies, implementing and implementing e-commerce laws and regulations. simplify the declaration, strengthen the implementation of tax collection solutions at source, prevent tax loss, strictly implement sanctions for handling tax and customs violations. Directing the General Department of Taxation to build a tax management database for e-commerce and business on digital platforms to apply risk management in tax management on a large database (the deadline for completion is 2023 at the latest).
The Ministry of Finance was assigned to assume the prime responsibility for developing a detailed plan on connecting and sharing data with the Ministry of Industry and Trade, the Ministry of Information and Communications, the Ministry of Public Security, the State Bank of Vietnam and relevant agencies to strengthen tax administration for e-commerce business activities, and the provision of cross-border digital products and services; develop regulations and standards for data connection and sharing (the deadline for completion is in the third quarter of 2023). At the same time, assume the prime responsibility for, and coordinate with the Ministry of Industry and Trade, the Ministry of Information and Communications, the Ministry of Public Security, the State Bank of Vietnam and relevant agencies in standardizing, digitizing, connecting and sharing data on e-commerce according to the specific roadmap of each ministry and sector.
The Prime Minister assigned the Ministry of Industry and Trade to assume the prime responsibility for, and coordinate with ministries and branches in, completing amendments to policies and laws on state management of e-commerce, in which to strengthen sanctions to handle violations of information storage and provision according to regulations on state management of e-commerce for subjects of e-commerce activities; build and put into operation a shared database on e-commerce to serve tax, customs and other state management work at the request of the Government (within 2025 at the latest).
In addition, the Ministry of Industry and Trade coordinated with the Ministry of Finance to develop a detailed plan on connecting and sharing data to strengthen tax administration for forms of domestic e-commerce activities; develop the current regulations and standards for data connection and sharing (the deadline for completion is in the third quarter of 2023); at the same time, cooperate in exchanging information with the Ministry of Finance to serve the inspection and examination; coordinate to handle violations of e-commerce activities in accordance with the law for enterprises, business households and individuals engaged in e-commerce activities that do not declare and pay taxes (the deadline for completion is 2023 at the latest).
The Ministry of Industry and Trade shall assume the prime responsibility for implementing the integration of electronic identification accounts, the application of chip-based citizen identification cards or residential data to authenticate the subjects of e-commerce activities participating in contract signing on the Vietnam e-contract development axis; administration, operation and stability assurance of the development axis of Vietnam's e-contracts (the deadline for completion is 2023 at the latest); have solutions to encourage organizations and enterprises providing e-commerce services to apply electronic identification accounts, chip-based citizen identification cards or resident data to authenticate information of organizations and individuals doing business on e-commerce trading floors (the deadline for completion is 2023 at the latest).
The Prime Minister assigned the State Bank of Vietnam to assume the prime responsibility for, and coordinate with ministries and branches in, finalizing the amendment of policies and laws on the national payment system, information security of credit institutions to serve the development of e-commerce, combat tax loss, and ensure monetary security. Continue to promote and encourage non-cash payments, develop electronic payment utilities to promote e-commerce.
At the same time, the State Bank of Vietnam coordinates with the Ministry of Finance and relevant ministries and branches in establishing a mechanism to manage and supervise payment transactions to support tax administration for cross-border service provision in e-commerce in accordance with the Law on Tax Administration and relevant laws.
The State Bank of Vietnam shall coordinate with the Ministry of Finance in formulating a detailed plan on directing and guiding commercial banks, credit institutions, and payment intermediary service providers licensed by the State Bank of Vietnam in connecting and providing information with tax authorities related to banking transactions of organizations and individuals, and coordinating with tax enforcement agencies to implement measures to enforce tax refunds within the time limit prescribed by the Law on Tax Administration III within the time limit of the Quarterly Law III.
Also at the Directive, the Prime Minister assigned the Ministry of Information and Communications, the Ministry of Public Security, and the Main Office to assume the prime responsibility for, and coordinate in performing related tasks in order to promote connection and data sharing for e-commerce development, combat tax loss, and ensure monetary security.
