Reforming the process of consolidating legal documents.

On May 29th, the Department of Legal Document Review and Enforcement (DDR) of the Ministry of Justice held a meeting to exchange and discuss the draft Decree detailing the technical presentation of consolidated legal documents. Deputy Director of the DDR, Nguyen Duy Thang, chaired the meeting.

In recent times, legal documents have been frequently amended and supplemented, significantly increasing the issuance of documents that amend or supplement multiple documents; documents whose content is amended or supplemented by various other documents; documents that are amended or supplemented multiple times in a short period; and many legal documents whose content is replaced, partially repealed, corrected, or declared invalid. This leads to the fact that searching for and applying legal documents requires effort and time, and it is difficult to ensure accuracy and completeness.
Furthermore, the 2012 Ordinance on the Consolidation of Legal Documents also reveals some limitations, such as: it does not regulate the consolidation of legal documents of local governments; it does not clearly define the legal value of consolidated documents in the reference, application, and enforcement of laws; it does not cover all forms of documents containing provisions that need to be consolidated; and some techniques for consolidating documents in the Appendix are not convenient...

According to Deputy Director Nguyen Duy Thang, in implementing the conclusions of the National Assembly Standing Committee and the directives of the Government leaders regarding the research, proposal, and drafting of a Government Decree providing technical guidance on the presentation of consolidated legal documents to ensure simultaneous effect with the Ordinance amending and supplementing a number of articles of the Ordinance on Consolidation of Legal Documents, the Department of Legal Document Review and Implementation - Ministry of Justice has recently chaired and coordinated with relevant agencies to research and draft a Government Decree providing technical guidance on the presentation of consolidated legal documents. The Decree aims to promptly institutionalize the views and policies of the Party and the State on reforming the work of lawmaking and consolidating legal documents.
The draft Decree is expected to amend and improve the format and layout of consolidated documents; revise and improve the technical presentation of consolidated documents to facilitate reference to consolidated documents, ensuring that consolidated documents can be submitted for publication in the Official Gazette, the National Database on Law, the electronic portal or website of agencies; and revise the method of annotation in consolidated documents to simplify the consolidation process for those involved in consolidation work.
Revise, supplement, and refine the technical presentation of consolidated texts in cases where amended or supplementary texts are consolidated (including texts amending, supplementing, correcting, partially repealing, partially expiring, partially suspending, or partially repealing legal documents). Supplement the technical presentation of consolidated texts at the local level; supplement the technical presentation of the draft consolidated content to be presented simultaneously with the draft amended or supplementary text when submitting for approval or signing...
At the meeting, delegates discussed and contributed suggestions to revise and finalize the draft Decree, from its format to the presentation of numbers, symbols, and names of consolidated documents; the legal basis for issuance in consolidated documents, etc., so that the consolidated documents can be easily tracked, statistically analyzed, searched, referenced, used, and cited.
