Resolving land and infrastructure issues for citizens and businesses is always a topical issue and receives considerable public attention. This is especially true in major cities such as Hanoi , Ho Chi Minh City, Hai Phong, and Quang Ninh.
According to media reports, in recent times, there have been numerous inadequacies and disputes regarding land and projects, leading to complaints and lawsuits from citizens and businesses, causing much frustration and conflicting information, significantly affecting the reputation of some officials and management agencies; at the same time, negatively impacting the morale of businesses and investors when operating in the area.
Recognizing the importance of resolving land disputes and focusing on solutions to improve the component indicators of the Provincial Competitiveness Index (PCI) in 2023, the Chairman of the Hanoi People's Committee, Tran Sy Thanh, directed the People's Committees of districts, counties, and towns to continue reviewing and implementing measures decisively to basically complete 100% of land use right certificate issuance in their areas; resolve obstacles and increase the rate of land use right certificate issuance to organizations; ensure transparency, compliance with regulations, and avoid creating difficulties for businesses related to land-related administrative procedures; rectify the situation of delayed processing of applications and issue written notices of application status and apologies to citizens when applications are delayed.
In addition, the Department of Natural Resources and Environment is assigned to take the lead in developing and implementing the Hanoi City Land Use Plan for the period 2021-2025 and the Land Use Rights Auction Plan for 2023 and the 5-year period 2021-2025.
The Hanoi Department of Natural Resources and Environment will coordinate with the People's Committees of districts, counties, and towns to publicly disclose information on land use planning and plans; organize the provision of land use planning and plan information to organizations and individuals in a convenient and timely manner; resolve difficulties and accelerate land clearance; review, compile statistics, and recover land from projects that are slow to implement or do not put the land into use according to the law; and develop specific solutions for projects that are slow to implement due to objective reasons in order to attract investment and avoid wasting land resources...
The Department of Natural Resources and Environment also needs to accelerate the construction of the cadastral record system and land management database, continue to simplify administrative procedures related to land, and implement them openly, transparently, and in accordance with regulations, without causing difficulties for businesses in carrying out administrative procedures related to land.
Following directives from the Hanoi People's Committee, the Me Linh District Party Committee issued Resolution 12/NQ-HU on July 1, 2023, on strengthening leadership and guidance in land and mineral resource management in Me Linh district. This move is considered positive and demonstrates the local government's determination to definitively resolve land-related disputes, complaints, and denunciations; many of which have been pending for a long time, causing land waste and public discontent.
In line with Resolution 12/NQ-HU of the Me Linh District Party Committee on land and mineral resource management in the district, Mr. Nguyen Hong Lam, General Director of Hong Lam Joint Stock Company, whose facility is located in Quang Minh Industrial Park, expressed his hope that land-related issues and investor rights in using infrastructure systems will be quickly and fairly resolved, ensuring a harmonious balance of interests between the state, businesses, and the community.
This will serve as a basis for recording businesses' perceptions when evaluating the dynamism and pioneering spirit of the provincial government, informal costs, or access to land and infrastructure... in order to prepare the Provincial Competitiveness Index Report - which the Vietnam Chamber of Commerce and Industry (VCCI) conducts surveys and asks numerous questions to businesses annually.
Similarly, in Ho Chi Minh City, Mr. Le Van Minh, representative of Dong Nam Real Estate Investment and Business Joint Stock Company, also submitted a request for the issuance of ownership certificates for the Dong Nam Housing Project in Thu Duc District starting from 2020.
After three years of going through numerous legal procedures, the company has only now been notified about the upcoming site inspection. This delay has significantly impacted the company's commercial operations because the incomplete legal documentation means that transactions between the developer and customers will be disrupted and become difficult.
Although the Ho Chi Minh City Department of Natural Resources and Environment has requested relevant units such as the City Land Registration Office, the Construction Inspectorate, and the People's Committee of Thu Duc City to coordinate and support the acceleration of the permit issuance process for the investor, the losses are difficult to compensate for, both in terms of time and business opportunities.
From a business perspective, Mr. Le Van Minh suggested that the government should specify the licensing process and publicly disclose information so that citizens and businesses can understand the procedures, processes, and timelines. Access to information and timely intervention from state management agencies are legitimate rights that both citizens and businesses need to be guaranteed and respected, in order to hope for a stable and favorable business environment for national development.
