Illegal detention will lead to other crimes such as: Intentional infliction of injury, extortion... These acts need to be strictly handled according to the provisions of the law.
The cases stemmed from unresolved debt, with the subjects disregarding the law, blatantly arresting, threatening, and controlling others. The developments of the cases are as follows:
The first case of "Illegal arrest and detention" occurred on May 1, 2023 in Binh Phu hamlet, Binh Thanh commune. Previously, the couple TT T (born in 1983, Tan Thanh commune, Giong Trom district, currently residing in Tien Giang ) and Mr. D.VC (born in 1994; residing in Thai Binh city, Thai Binh province) had a business relationship with each other. Thereby, D.VC owed Mr. and Mrs. T. 25 million VND. On April 30, 2023, knowing that Mr. C was in Giong Trom, Mr. and Mrs. T. came to find him.
On May 1, 2023, T and his wife invited 4 other people in Giong Trom to go find Mr. C to collect the debt. The group of 6 people discovered that Mr. C and his wife were at a restaurant in Binh Thanh commune. The people rushed in and beat them, sprayed pepper spray on Mr. C, then restrained him and pushed him into a car to take him to T's biological father's house in Tan Thanh commune, Giong Trom. Currently, the Investigation Police Department of Giong Trom District Police has issued a decision to temporarily detain 3 people for the act of "Illegal arrest and detention" and continue to verify and consolidate the case file for handling according to the provisions of law.
The second case of "Illegal arrest and detention" occurred on May 7, 2023 in Kinh Trong hamlet, Binh Hoa commune. Mr. D.CH (born in 1987, Ward 12, Go Vap District, Ho Chi Minh City) is a boatman who owes NTA (born in 1982, Kinh Trong hamlet, Binh Hoa commune, Giong Trom district) 50 million VND. Therefore, A. received Mr. C.'s wages from going to sea to pay off the debt and forced Mr. C. to stay at the subject's house until the debt was paid.
On May 4, 2023, H. asked A. to visit his family but was refused. On May 7, 2023, H. ran away from A.'s house but was caught by A. and brought back home. The case is currently being investigated, verified, and clarified.
The third case of "Illegal arrest and detention" occurred on May 6, 2023 in Hung Binh A hamlet, Thanh Phu Dong commune, Giong Trom district. On May 6, 2023, NVT (born in 1987, My Thanh commune, Giong Trom district) and PHT, who live in the same locality, went to Cai Mit market area, Thanh Phu Dong commune, Giong Trom district to find Ms. PTD (born in 1992, Thanh Phu Dong commune, Giong Trom district) to collect debt. When discovering D., the two subjects chased and dragged Ms. D. onto a motorbike and drove to My Thanh commune, Giong Trom district.
Upon receiving the report, the police deployed forces and professional measures to arrest two subjects who were holding the victim at a coffee shop in My Thanh commune, Giong Trom district. Currently, the Investigation Police Department of Giong Trom district police has issued a decision to temporarily detain NVT and PHT for the act of "Illegal arrest and detention" and continue to verify and consolidate the case file for handling according to the provisions of law.
According to the District Police, through actual investigation, most cases of illegal detention stem from social conflicts such as: economic business, debt... The masterminds in these cases often have relationships and know the victims.
According to the provisions of law, the penalty for those who commit acts of illegal arrest, detention or imprisonment is specifically prescribed in Article 157 of the 2015 Penal Code.
