Hanoi requires handover, management and handling of public assets when rearranging administrative units

Hanoi City requires the (new) commune-level administrative unit where the district-level People's Committee headquarters is located to be responsible for inheriting, receiving, and implementing the management and handling of assets according to regulations.

On May 30, Vice Chairman of Hanoi People's Committee Nguyen Trong Dong signed and issued Document No. 3247/UBND-KT on the handover, management and handling of public assets, which are infrastructure assets, assets with established public ownership, and assets of projects using state capital when implementing the arrangement and reorganization of administrative units.

According to the City People's Committee, on May 15, 2025, the Ministry of Finance issued Document No. 6606/BTC-QLCS on additional guidance on the handover, management, and handling of public assets, which are infrastructure assets, assets with established public ownership, and assets of projects using state capital when implementing the arrangement and reorganization of administrative units.

To ensure the handover, management and handling of public assets such as infrastructure assets, assets with established public ownership, assets of projects using state capital when implementing the arrangement and reorganization of administrative units in accordance with regulations and effectively, the City People's Committee requests heads of departments, branches, organizations, units, People's Committees of districts, towns and cities to direct agencies, organizations, units, People's Committees of communes under their management to implement the following contents:

Agencies, organizations, and units subject to administrative unit arrangement shall conduct inventory and make a list of public assets, which are infrastructure assets, assets with established public ownership, and assets of projects using state capital that the agency, organization, or unit is managing/temporarily managing.

On that basis, based on the Project on rearrangement and reorganization of administrative units at all levels approved by competent agencies and individuals, the assets will be handed over to agencies, organizations and units assigned the responsibility of receiving and managing assets according to the provisions of law and the direction of the City People's Committee in this Document.

Agencies, organizations and units assigned with the responsibility of receiving are responsible for receiving assets, managing and handling assets in accordance with the provisions of law; ensuring no interruption in service provision, serving national interests, public interests, and not causing loss or waste of assets.

For infrastructure assets currently managed by the commune level, the (new) commune-level administrative unit formed after the implementation of the arrangement of commune-level administrative units is responsible for receiving and inheriting the management and use of infrastructure assets currently managed and used by the (old) commune-level administrative unit.

In case the old commune-level administrative unit is split into many parts to form new commune-level administrative units, the new commune-level administrative unit is responsible for receiving and inheriting the management and use of infrastructure assets of the old commune-level administrative unit located in the area according to the new commune-level administrative unit.

In case the assets are located in many new commune-level administrative units, the specialized department managing the sector or field under the City People's Committee or the (new) commune-level administrative unit shall receive and inherit the management and use according to the state management decentralization prescribed in the Resolution of the City People's Council on decentralization of state management of a number of socio -economic fields in Hanoi when applying the 2-level local government organization model or regulations of specialized laws (if any).

For assets managed by the asset management unit which is an agency, organization or unit under the commune level and has not completed the handling by the time of the arrangement of the commune-level administrative unit: The (new) commune-level administrative unit formed after the arrangement of the commune-level administrative unit is responsible for receiving, managing and handling the assets managed by the (old) commune-level administrative unit.

In case the old commune-level administrative unit is divided into many parts to form new commune-level administrative units: The new commune-level administrative unit that receives, manages and handles assets is the unit with the headquarters of the old commune-level People's Committee in the area.

For assets managed by the asset management unit, which is an agency, organization or unit under the district level and has not completed the handling by the time the district-level administrative unit is removed: The commune-level administrative unit (new) where the district-level People's Committee headquarters is located will be responsible for inheriting, receiving, and implementing the management and handling of assets according to regulations.
