According to the General Department of Customs, the classification determines the inspection of import and export goods. In particular, according to the provisions of the 2014 Customs Law, goods classified in the green channel are exempt from document inspection and physical inspection; goods classified in the yellow channel are subject to document inspection and physical inspection; and goods classified in the red channel are subject to detailed document and physical inspection.
On average, each year, the number of green lane declarations reaches about 7 - 8 million, accounting for about 66%. In the first 9 months of 2023 alone, the number of green lane declarations reached over 6.8 million, accounting for 66.6%, an increase of 0.78% over the same period last year. The remaining 29.6% are yellow lane declarations; 3.43% are red lane declarations.
Customs has proposed many measures to facilitate trade on the one hand and prevent trade fraud on the other hand.
Usually, the customs clearance time for green lane declaration is very fast, the work is done through the Automatic Customs Clearance System, so businesses do not have to go to the customs office and can directly pick up the goods at the port.
Therefore, the General Department of Customs said that some businesses have taken advantage of the policy of facilitating customs clearance to carry out smuggling and trade fraud with sophisticated methods and tricks. Specifically, due to the automatic classification system, when knowing in advance that the shipment will be classified as green, businesses add or remove goods to cheat, legalize fraud or mix in smuggled goods. Second, taking advantage of exemption from document inspection and actual inspection to falsify documents and documents. Third, falsely declaring the name, type, origin, and type of goods that are not true to reality; not declaring or missing the legal document code for goods subject to specialized management; declaring them in the group of simple goods, outside the specialized management list of ministries, branches, etc.
Based on the above reality, the General Department of Customs said that the industry has proposed many measures to facilitate trade on the one hand and prevent trade fraud on the other hand.
Specifically, build risk profiles and key route profiles for imported goods before they arrive at the port, focus on analyzing information on E-manifest, and choose pre-clearance screening to promptly and proactively detect violating shipments as soon as they arrive at the port.
Non-invasive inspection by screening before carrying out customs procedures for imported goods at the import gate; screening for exported goods after customs clearance at the export gate; post-clearance inspection; specialized inspection and professional measures to prevent and combat smuggling and illegal transportation of goods across the border...
At the same time, regularly review and analyze data on green lane declarations, compare with data across the industry for screening; make a list of key shipments and enterprises according to each criterion index, pre-screen imported shipments (declarations not yet opened) showing signs of risk...
As a result, in 2022, at seaports in Ho Chi Minh City and Hai Phong, customs forces discovered 295 green and yellow lane shipments violating the regulations on undeclared imports, false declaration of types and quantities, and imports of goods that do not meet the conditions. In the past 9 months, there were 229 shipments of declarations (including 217 import declarations and 12 export declarations) in green and yellow lanes violating the regulations on false declaration of types and quantities, and imports of undeclared goods, imports that do not meet the standard conditions, and no import-export license for prohibited goods, Cites goods, etc.
Total fines are 21.4 billion VND, tax arrears are 80.73 billion VND.
